A child should be brought before a<br />

The Convention on the Rights of the Child, <strong>in</strong> article 37, prohibits torture and other<br />

cruel, <strong>in</strong>human or degrad<strong>in</strong>g treatment or punishment (see box). It further provides that<br />

parties to the Convention “shall take all appropriate legislative, adm<strong>in</strong>istrative, social and<br />

educational measures to protect the child from all forms of physical or mental violence,<br />

<strong>in</strong>jury or abuse, neglect or negligent treatment, maltreatment or exploitation, <strong>in</strong>clud<strong>in</strong>g<br />

sexual abuse, while <strong>in</strong> the care of parent(s), legal guardian(s) or any other person who<br />

has the care of the child”. 6 The Committee on the Rights of the Child has further stated<br />

that “any discipl<strong>in</strong>ary measure […] <strong>in</strong>clud<strong>in</strong>g corporal punishment, placement <strong>in</strong> a dark<br />

cell, closed or solitary conf<strong>in</strong>ement, or any other punishment that may compromise<br />

the physical or mental health or well-be<strong>in</strong>g of the child concerned” must be strictly<br />

forbidden. 7<br />

As general guidance, follow<strong>in</strong>g are some examples of practices that amount to<br />

torture or cruel, <strong>in</strong>human or degrad<strong>in</strong>g treatment accord<strong>in</strong>g to the Committee aga<strong>in</strong>st<br />
