Chapter 3 Application of criminal law<br />

[s 10A]<br />

(1) Under section 7, a person’s criminal responsibility extends to<br />

any offence that, on the evidence admissible against him or<br />

her, is either the offence proved against the person who did<br />

the act or made the omission that constitutes that offence or<br />

any statutory or other alternative to that offence.<br />

(2) Under section 8, a person’s criminal responsibility extends to<br />

any offence that, on the evidence admissible against him or<br />

her, is a probable consequence of the prosecution of a<br />

common intention to prosecute an unlawful purpose,<br />

regardless of what offence is proved against any other party to<br />

the common intention.<br />

(3) This section does not limit any other provision of this chapter.<br />

Chapter 3 Application of criminal law<br />

11 Effect of changes in law<br />

(1) A person can not be punished for doing or omitting to do an<br />

act unless the act or omission constituted an offence under the<br />

law in force when it occurred; nor unless doing or omitting to<br />

do the act under the same circumstances would constitute an<br />

offence under the law in force at the time when the person is<br />

charged with the offence.<br />

(2) If the law in force when the act or omission occurred differs<br />

from that in force at the time of the conviction, the offender<br />

can not be punished to any greater extent than was authorised<br />

by the former law, or to any greater extent than is authorised<br />

by the latter law.<br />
