friend, it is my understanding that there is not an
issue with respect to documents that I had intended
to enter that were obtained by way of the search
warrant. So, in other words, there will not be a
challenge under Section 8(2) of the search warrant.
Perhaps my friend can confirm that?
MR. BUCKLEY: Yeah, that's -- that's
correct, Your Honour, and as my friend can
appreciate, we got notice at the end of last week of
what documents my friend was going to rely on, and
actually, so I didn't even get a chance to go
through the materials that he wanted to enter and I
don't have a concern with them. So, I don't want to
waste the court's time on a Section 8 challenge for
documents that don't concern the defence.
MR. BROWN: Yes, and --
MR. BUCKLEY: So, I'm not conceding
continuity but we're not going to go through a
Section 8 voir dire.
THE COURT: That is fine. Thank you.
MR. BROWN: And certainly, in fairness to
my friend, sir, I am not suggesting he has sprung
this on the Crown in any way. It's just that we
will need to seek a brief adjournment, sir. My
witness is basically ready to deal with issues
around the search warrant. I'll need to have a
chance to speak with her about the other evidence
