77 In the case <strong>of</strong> a wheel spinning <strong>of</strong>fense, there is no licensing sanction for a first <strong>of</strong>fense. However, the mandatory 1 year<br />

suspension applies for subsequent <strong>of</strong>fenses. CDR 73-600-045<br />

78 Given the language used in Title 21, §4172(d), this sanction appears to be mandatory.<br />

79 The law provides that for a first <strong>of</strong>fense the imprisonment sanction can be suspended. As a result, it would seem that the<br />

minimum incarceration sanction for subsequent <strong>of</strong>fenses is mandatory. Title 21, §4175(b)<br />
