4 2009 Annual Report From the President Tom O’Callaghan I invite ORBA members to review the enclosed reports and highlights from 2009 and I trust that when you do, you will agree that ORBA continues to deliver tangible benefits and full value to members. It has been a busy and productive year for your Association, from progress made on legislative and technical issues to the introduction of new member services and a comprehensive strategic planning project that will set the course for ORBA into the future to best serve our members. The audited financial statements at the end of this report will attest to the ongoing financial health and the efficient management of your membership fees. There were unusual, one-time expenses last year which produced the first deficit statement in decades. However, major contribution to McMaster University and Georgian College were committed by previous boards with the intent they were to come from the general surplus, but they do appear as an expense on the 2009 statement. The Association also had significant legal expenses in 2009, resulting from its involvement in two court cases where issues affecting public tendering were in question. Both cases involved member companies, but in both cases we made every effort to not interfere with the substantive issues of the cases. We were successful in a ruling that upheld principles related to late tenders and we were able to establish that the Ministry of Transportation’s procurement practices are not protected from public challenge by way of judicial review. In addition to completing our Strategic Planning process, some of the highlights from 2009 that I think are particularly noteworthy include the success of the Ontario Civil Construction Careers Institute, growing infrastructure budgets and our work with MTO on issues such as QA for acceptance, general conditions revisions and performance specifications to name a few. ORBA was active and effective on an expanding list of legislative and regulatory issues in 2009, representing members’ interest in the ban on mobile communications devices, the new College of Trades, the HST, safety association amalgamations, WSIB policy and many more that directly affect our businesses. Thank you for the opportunity to work on your behalf in the past year with government, industry organizations and others on the issues that affect all contractors. My sincere thanks to the Board of Directors, ORBA staff and the many members that volunteer on ORBA committees for their hard work and dedication over the past year. Volunteers are the strength of our Association and your commitment creates the industry improvements and ORBA successes that fill the pages of this Annual Report.
Strategic Planning A draft ‘Strategic Plan 2010-2014’ was presented to the ORBA Board of Directors in January, 2010, to be finalized and implemented by the new Board of Directors. The new Strategic Plan has evolved from a process that began in the spring of 2009 with a survey of members and a comprehensive SWOT analysis (strengths, weaknesses, opportunities, threats) by the Board of Directors. In the summer and fall a Strategic Planning Team chaired by president, Tom O’Callaghan, met to shape the consultant’s report and recommendations into a plan for presentation to the Board. The survey processes used in the planning process established ORBA members’ five current top priorities, as well as identifying the services most valuable to them. This data will not only form the basis of the Plan’s objectives, but will be used by the Board and committees in implementing the objectives over the next five years. The Plan will also address ORBA sustainability and relevance to members in a rapidly changing business environment and will lead to revisions to programs and services to respond to their evolving needs and expectations. One of the major focuses of the new Strategic Plan will be on increasing membership in the municipal contracting sector. Current benefits to municipal contractors will be better communicated and new programs and services will be developed with an emphasis on the municipal focus. Other major themes that will be addressed by the new Strategic Plan include improved communications with members and enhanced use of new technology, as well as structural changes to the way the ORBA Board and committees work and interact. 2009 Annual Report 5
