C. AREAS FOR FUTURE RESEARCh AT ThE POLICY LEVEL<br />

The follow<strong>in</strong>g areas require further research; they<br />

may be addressed <strong>in</strong> upcom<strong>in</strong>g research and/or by<br />

FIND and MAP <strong>in</strong>itiatives:<br />

• <strong>Microf<strong>in</strong>ance</strong> Law. There seems to be different<br />

requirements for local and <strong>in</strong>ternational<br />

organizations to get a license (see Appendix A of<br />

Directive 2).<br />

• Portfolio quality. How do MFIs report their<br />

portfolio quality to the supervisors? There are<br />

no standards cited <strong>in</strong> the report<strong>in</strong>g formats<br />

of the <strong>Microf<strong>in</strong>ance</strong> Law Instructions.<br />

• Transformation of projects and NGOs <strong>in</strong>to forprofit<br />

MFIs. The transformation of the UNDP<br />

project <strong>in</strong>to a legal MFI will raise several<br />

questions, as will the transformation of NGOs<br />

<strong>in</strong>to for-profit MFIs <strong>in</strong> the future. See Lauer<br />

(2008).<br />

• Consumer protection. Given the high level of<br />

over-<strong>in</strong>debtedness of farmers <strong>in</strong> several areas<br />

of <strong>Myanmar</strong>, it is important to explore how<br />

the current legal environment will protect<br />

clients aga<strong>in</strong>st over-<strong>in</strong>debtedness and abusive<br />

collection lend<strong>in</strong>g.<br />

• Bank downscal<strong>in</strong>g. With the new conditions for<br />

secured lend<strong>in</strong>g transactions, where gold and<br />

agricultural production can be considered as<br />

collateral, banks may be able to downscale <strong>in</strong><br />

the future. Further research on this opportunity<br />

would be useful. Bank downscal<strong>in</strong>g could have<br />

regulatory consequences (e.g., how would the<br />

microf<strong>in</strong>ance portfolio of a bank be regulated<br />

and supervised?).<br />

• Foreign direct <strong>in</strong>vestment and bank<strong>in</strong>g sector laws.<br />

It is important to understand the dynamics<br />

of this issue and when foreign <strong>in</strong>vestors will<br />

be able to engage <strong>in</strong> a jo<strong>in</strong>t venture. There are<br />

<strong>in</strong>dications of emerg<strong>in</strong>g partnerships (e.g., with<br />

S<strong>in</strong>gapore banks).<br />

• Agent regulation. Accord<strong>in</strong>g to some of our<br />

<strong>in</strong>terviews, an agent regulation is <strong>in</strong> the<br />

works. It would be useful to f<strong>in</strong>d out more<br />

about this regulation as it could open some<br />

new opportunities for branchless bank<strong>in</strong>g<br />

(see Duflos [2012]).<br />

• AML/CFT. Accord<strong>in</strong>g to the Central Bank, the<br />

government has created a F<strong>in</strong>ancial Intelligence<br />

Bureau that <strong>in</strong>cludes the Central Bank. The team<br />

was told that the requirements from the AML/<br />

CFT Law are quite strict and require show<strong>in</strong>g<br />

an ID card and hav<strong>in</strong>g two <strong>in</strong>troducers. More<br />

research on how to adapt such requirements to<br />

low-<strong>in</strong>come segments would be useful.<br />

• Regulation and supervision of cooperatives.<br />

The M<strong>in</strong>istry of Cooperatives has township<br />

antenna with up to 10 supervisors who control<br />

cooperatives f<strong>in</strong>ancial statements quarterly and<br />

conduct monthly onsite supervision. The quality<br />

of this supervision should be assessed.<br />

• Pawn shops. There are different op<strong>in</strong>ions <strong>in</strong> the<br />

sector on how pawn shops are regulated and<br />

supervised. Additional research on that front<br />

would be welcome.<br />
