<strong>The</strong> only thing that can be said with certainty is that a node forwarded a packet, but<br />

as I will explain in Chapter 5.3.4, this shouldn’t be a problem in most modern societies.<br />

5.3.4 legal implications <strong>of</strong> being a proxy<br />

Before I start talking about the legal implications, I’d first like to clarify that I am not<br />

a lawyer and can only rely on talks with people who have actually studied law.<br />

As this thesis is written in Germany, I’d like to give a short overview <strong>of</strong> the <strong>current</strong><br />

german laws regarding the situation <strong>of</strong> a proxy in a network. This is important to<br />

know as some <strong>of</strong> the implementations <strong>of</strong> <strong>anonymous</strong> <strong>file</strong>-<strong>sharing</strong> protocols like the ones<br />

implementing a form <strong>of</strong> proxy chaining will put data on your node and make it the origin<br />

<strong>of</strong> material that might be copyright infringing or pornographic without the your node<br />

specifically asking for it.<br />

While communication is encrypted in most <strong>of</strong> the cases, it might happen that the node<br />

directly in front or directly behind you in a proxy chain will try to sue you for forwarding<br />

(in a simpler view: "sending out") or receiving a <strong>file</strong>. That could be because the <strong>file</strong> your<br />

node forwarded is being protected by copyright or the content itself is illegal (e.g. child<br />

pornography). Especially in the case <strong>of</strong> severely illegal things like child pornography,<br />

it’s important to know how the <strong>current</strong> legal situation might affect the owner <strong>of</strong> a node<br />

who might not even know that kind <strong>of</strong> data was forwarded.<br />

As a simple "proxy", the user should be covered by §9 TDG:<br />

§9 TDG: Durchleitung von Informationen<br />

1. Dienstanbieter sind für fremde Informationen, die sie in einem Kommu-<br />

nikationsnetz übermitteln, nicht verantwortlich, s<strong>of</strong>ern sie:<br />

• 1. die Übermittlung nicht veranlasst,<br />

• 2. den Adressaten der übermittelten Informationen nicht ausgewählt<br />

und<br />

• 3. die übermittelten Informationen nicht ausgewählt oder verändert<br />

haben.<br />

Satz 1 findet keine Anwendung, wenn der Dienstanbieter absichtlich mit<br />

einem Nutzer seines Dienstes zusammenarbeitet, um eine rechtswiedrige<br />

Handlung zu begehen<br />
