ITMA BUSINESS During the next day, Felicity Hide of Boult Wade and Tennant continued the topical theme surrounding the changes in the Examination process at the UK Registry by providing practical commentary upon the changes. As the changes will certainly lead to an increase in oppositions, settlement negotiations and agreements, Jeremy Dickerson, partner and head of the IP litigation team at Burges Salmon, emphasised key areas for consideration when drafting settlement or coexistence agreements. Andrew Norris, a barrister of Hogarth Chambers, concentrated upon what constitutes “genuine use” under Article 12(1) of the Directive and then, the extent to which goods and services are covered, other than those genuinely used. Richard Ashmead followed with a discussion about the differences in practice concerning non-use between OHIM and the UK. Rachel Gillard-Jones of BP provided the audience with the benefit of her experience as a general manager for a trade mark watching company in explaining how a trade mark owner might set about devising and implementing an appropriate watch strategy. John Groom of Groom Wilkes and Wright discussed Article 4(4) focusing upon the interpretation of the legal concepts enshrined within that Article’s wording. Throughout, the sessions were wittily and deftly chaired by ITMA’s President, Phil Harris. Gillian Deas also chaired a session. Behind the scenes, the ITMA team worked tirelessly to ensure that all ran smoothly, that the bar remained open beyond midnight, that the microphones reached those that wanted to pose questions and generally to ensure that a good time was had by all. On the social side, and ITMA has always been good at this, delegates and accompanying guests were treated to two fabulous evenings out. The first involved a sumptuous feast, accompanied by local wines and prosecco at the Villa Braida. The second was the closing dinner at the Hotel Monaco right on the waterfront in Venice just adjacent to St Marks Square. The excitement was palpable as we were transported by coach and then by boat, glittering moonlight reflecting in the water, direct to the hotel’s jetty. The hotel provided a magnificent and stunning setting for a marvellous meal. Background entertainment was provided by a costumed and be-wigged string quartet. Perfect! To conclude: Although we keep ourselves up to date via a variety of sources, it occurs to me that nothing beats having the opportunity to focus on current topics in a conference setting, to be taken through issues and cases from eminent colleagues who have taken time to distil the necessary information, coupled with the chance to question and discuss. Not to mention the conviviality, of course, of being amongst friends.
