LPA - the misconduct is of such a nature that it warrants a penalty which have not only a punitive affect but a deterrent one. The appellant who had a long standing relationship with MTUC should be forthright and transparent in his dealings and discharge his duties promptly, conscientiously, and diligently instead of misconducting himself in the manner he did. We do not see any justification for us to interfere in the penalty meted out which in our view is appropriate and just in the circumstances of the case. The appeal is accordingly dismissed with costs. As the 3 rd respondent is not claiming any costs no order as to costs is made in favour of the 3 rd respondent. The 1 st and 2 nd respondent is awarded costs in the sum of RM1,000.00. Deposit to the 1 st and 2 nd respondent to account of fixed costs.
