wishes. (Cavagnero, p. 91). The committee, however, felt that the importance <strong>of</strong> contact<strong>in</strong>g an<br />

applicant’s most recent supervisor outweighed the applicant’s wishes, at least under the<br />

circumstances. (Id.). S<strong>in</strong>ce Gaskell was no longer <strong>in</strong> jeopardy <strong>of</strong> los<strong>in</strong>g his job at the University<br />

<strong>of</strong> Nebraska, Cavagnero took the liberty <strong>of</strong> contact<strong>in</strong>g Kirby about Gaskell. (Id.).<br />

Kirby provided Cavagnero quite a bit <strong>of</strong> <strong>in</strong><strong>for</strong>mation about Gaskell, much <strong>of</strong> which was<br />

positive. (Cavagnero, p. 94). Not all <strong>of</strong> Kirby’s comments were positive, however. Kirby said<br />

that Gaskell’s ma<strong>in</strong> source <strong>of</strong> conflict with the UNL faculty was his constant desire to decrease<br />

his teach<strong>in</strong>g load. (Cavagnero, p. 95). Although Gaskell had been hired to primarily teach,<br />

Kirby told Cavagnero that Gaskell applied some <strong>of</strong> his research fund<strong>in</strong>g toward the hir<strong>in</strong>g <strong>of</strong> an<br />

<strong>in</strong>structor to replace him as a teacher so that he could focus more exclusively on research. (Id.).<br />

Kirby was placed <strong>in</strong> a difficult position <strong>of</strong> hav<strong>in</strong>g to hire replacement <strong>in</strong>structors. (Id.). Kirby<br />

also told Cavagnero that Gaskell <strong>of</strong>ten refused to accept the decisions <strong>of</strong> his colleagues and<br />

adm<strong>in</strong>istrators, constantly f<strong>in</strong>d<strong>in</strong>g ways to rehash old issues. (Cavagnero, p. 97). Cavagnero<br />

shared the details <strong>of</strong> this conversation with the advisory committee chair, Dr. Tom Troland. 16<br />

Dur<strong>in</strong>g the search process, one <strong>of</strong> the advisory committee members, Sally Shafer, did a<br />

search on the <strong>in</strong>ternet <strong>for</strong> <strong>in</strong><strong>for</strong>mation about Gaskell and found his University <strong>of</strong> Nebraska web-<br />

site which l<strong>in</strong>ked to Gaskell’s personal web site conta<strong>in</strong><strong>in</strong>g an article which Gaskell titled<br />

Sally circulated the article to the advisory<br />

committee members. Because the article referenced certa<strong>in</strong> religious topics, the members <strong>of</strong> the<br />

advisory committee approached Cavagnero with concerns about whether they could consider<br />

Gaskell’s statements which appeared to blend religious thought with scientific theory.
