paltry disclosure simply cannot encompass all of the items involved in the “multiple” trips <strong>to</strong><br />

make copies <strong>and</strong> five armloads of materials that Freshwater <strong>to</strong>ok from his classroom. Freshwater<br />

undoubtedly has retained some of these materials, but he has refused <strong>to</strong> turn them over <strong>to</strong> the<br />

Dennises. The Dennises raised the issue of Freshwater’s incomplete production with the Court<br />

during the April 21, 2010 conference call, <strong>and</strong> the Court ordered Freshwater <strong>and</strong> Mr. Hamil<strong>to</strong>n<br />

either <strong>to</strong> produce the materials, if they had them, or <strong>to</strong> provide affidavits attesting <strong>to</strong> the fact that<br />

no other materials remain <strong>to</strong> be produced. The Dennises further requested these materials in<br />

their April 22, 2010 letter. (Ex. D.) Once again, however, Freshwater failed <strong>to</strong> produce any<br />

additional documents or <strong>to</strong> provide the affidavits swearing that no additional materials exist.<br />

v. Textbooks/Books<br />

Freshwater also has failed <strong>to</strong> produce various textbooks <strong>and</strong> educational materials subject<br />

<strong>to</strong> the Court’s orders. (See Mot. <strong>to</strong> Compel at 4.) On April 19, 2010, Freshwater produced a<br />

mere 20 copied pages from Finding Common Ground <strong>and</strong> another five copied pages from the<br />

textbook Cells, Heredity, <strong>and</strong> Classification. (See Ex. J, # 105-108.) These copies were<br />

incomplete <strong>and</strong> many pages were illegible. During the April 21, 2010 telephone conference, the<br />

Court specifically ordered Freshwater <strong>to</strong> produce his personal copy of Finding Common Ground<br />

<strong>to</strong> the Dennises by April 22, 2010. Freshwater complied, <strong>and</strong> that book was promptly returned.<br />

This sliver of compliance, however, does not suffice; many textbooks or copies of<br />

textbooks with Freshwater’s notes have yet <strong>to</strong> be produced. In the termination hearing on<br />

December 10, 2009, Freshwater introduced Employee Exhibit 114, Cells, Heredity <strong>and</strong><br />

Classification, in his own defense. Freshwater Termination Hearing, John Freshwater Test.,<br />

12/10/09, at 4322 (Ex. G) (noting Employee Ex. 114). The few pages produced on April 19,<br />

2010 (Ex. J, # 105-108) do not provide the Dennises with the complete Cells, Heredity <strong>and</strong><br />

Classification textbook. What is more, most of the pages actually produced are illegible. The<br />
