Recommendations to <strong>the</strong> Director-General for fur<strong>the</strong>r transmission to <strong>the</strong> Governing<br />
Bodies?<br />
• More importantly, <strong>the</strong> <strong>FAO</strong> Conference adopted amendments at its Thirty-sixth Session to<br />
<strong>the</strong> <strong>FAO</strong> Constitution which should be reflected in this Rule. They incorporated<br />
recommendations <strong>of</strong> <strong>the</strong> Immediate Plan <strong>of</strong> Action (IPA action 2.56) to include new<br />
reporting lines for <strong>the</strong> Technical Committees so <strong>the</strong>y will report to <strong>the</strong> Council on<br />
programme and budget matters and to <strong>the</strong> Conference on policy and regulatory matters<br />
Panel recommendations<br />
1. The Agreement is weak and outdated and <strong>the</strong>re are many fundamental areas that need<br />
improvement. The weaknesses and gaps identified are, or have a potential to be, major<br />
impediments to <strong>the</strong> effective and efficient functioning <strong>of</strong> <strong>the</strong> Commission and its ability to effect<br />
long-term sustainability <strong>of</strong> <strong>fisheries</strong> and sustainable development <strong>of</strong> aquaculture in <strong>the</strong> Region.<br />
2. The GFCM Agreement should be <strong>review</strong>ed and ei<strong>the</strong>r amended or replaced by a new instrument.<br />
A decision on whe<strong>the</strong>r to amend <strong>the</strong> Agreement or replace it should be made taking into account<br />
<strong>the</strong> full range <strong>of</strong> deficiencies identified by <strong>the</strong> Panel.<br />
3. The GFCM Rules <strong>of</strong> Procedure should be <strong>review</strong>ed and amended taking into account current <strong>FAO</strong><br />
rules and practice, “best practice” standards <strong>of</strong> o<strong>the</strong>r RFMOs, <strong>the</strong> inconsistencies with <strong>the</strong><br />
Agreement as well as <strong>the</strong> inconsistencies within <strong>the</strong> Rules <strong>of</strong> Procedure, gaps and <strong>the</strong> failure to<br />
address certain areas <strong>of</strong> importance.<br />
4. ANALYSIS OF THE PERFORMANCE REVIEW CRITERIA<br />
4.1 Conservation and management<br />
4.1.1 Status <strong>of</strong> living marine resources<br />
Information on <strong>the</strong> status <strong>of</strong> living marine resources is taken from stock assessments carried out under<br />
<strong>the</strong> auspices <strong>of</strong> GFCM. The distribution <strong>of</strong> stock assessments indicates <strong>the</strong> priorities that were given<br />
to assessing stocks in certain GSAs, with <strong>the</strong> largest majority <strong>of</strong> stock assessments being from <strong>the</strong><br />
nor<strong>the</strong>rn and western GSAs in <strong>the</strong> GFCM Area. The distribution <strong>of</strong> stock assessments <strong>review</strong>ed by <strong>the</strong><br />
