SPILL REPORTING INSTRUCTIONS: KDHE The spiller is responsible to report to all of the appropriate state agencies depending on the material and volume spilled. Kansas Regulation K.A.R. 28-48 as authorized by K.S.A. 65-171d explains what is reportable to Kansas Department of Health and Environment (KDHE). K.A.R. 28-48 and K.S.A. 65-171d are included on pages 8 through 11 of this packet. To satisfy the requirements of K.A.R. 28-48-2 you must report all spills that impact the soils or waters of the state to KDHE or in the case that it originates from an oil or gas production lease, be reported to the KCC. KDHE Spill / Complaint Reporting Number (24/7) 785-296-1679 KCC Regulated Spills Spills reportable to the KCC should be directed to the appropriate KCC numbers listed on page 7. Call the KDHE spill line if an oil lease spill flows off lease into a waterway after normal business hours or if it is reportable to the National Response Center (NRC). LEPC/KDEM If the release is not contained or threatens the health or safety of the local population the Local Emergency Planning Committee (LEPC) within the county of the release must be notified first by dialing 911. Hazardous materials spills and air releases that meet federal reportable quantities must also be reported to Kansas Division of Emergency Management (KDEM), which receives reports for the Commission on Emergency Planning & Response (CEPR). The federally listed chemicals and reportable quantities can be obtained at www.epa.gov/emergencies under the tab of “List of Lists”. KDEM requires that oil and petroleum spills over 110 gallons be reported to their number. KDEM Hazmat Spills and Air Releases (24/7) 800-905-7521 National Response Center If the spill is reportable to KDEM, it must also be reported to the National Response Center (NRC). Federal law also requires that any oil spill that has impacted or threatens a waterway must be reported to the NRC. EPA Region 7 Emergency Response Branch personnel monitor the NRC reports and may call the spiller back for more information. NRC 24-hour number 800-424-8802 Page 3 of 11
