10. On November 12, 2010, Plaintiff filed the Complaint in this action against
Defendant. (DE 1.)
11. On November 12, 2010, Plaintiff also filed its Motion for Ex Parte Application
for Entry of Temporary Restraining Order and Preliminary Injunction and Order Authorizing
Alternate Service of Process on Defendant. (DE 5.)
12. On November 23, 2010, the Court entered an Order granting Plaintiff’s Ex Parte
Application for Entry of a Temporary Restraining Order and Preliminary Injunction and Order
Authorizing Alternate Service of Process. (DE 9.) Pursuant to the Court’s Order, Plaintiff served
the Defendant with copies of the Summons and Complaint via publication on December 2, 2010
and via e-mail on December 3, 2010. Plaintiff filed the Proofs of Service as to Defendant on
December 6, 2010. (DE 11-12.) As Defendant failed to respond to Plaintiff’s Ex Parte
Application, on December 23, 2010, this Court granted Plaintiff’s Application for a Preliminary
Injunction. (DE 15.)
