Import Declaration<br />

<strong>IKEA</strong> will not be recommend<strong>in</strong>g that the declaration requirement be removed from Lacey Act<br />

Amendments as we recognize the importance to susta<strong>in</strong>ability <strong>and</strong> the value of importers<br />

know<strong>in</strong>g the type of wood used <strong>and</strong> the orig<strong>in</strong> of wood <strong>in</strong> their products. Nevertheless, it has<br />

become apparent that there are some challenges with the declaration requirement as it <strong>is</strong><br />

written <strong>and</strong> <strong>IKEA</strong> believes Congress should improve <strong>and</strong> streaml<strong>in</strong>e the import declaration<br />

requirement. <strong>IKEA</strong> has found that provid<strong>in</strong>g genus, species <strong>and</strong> country of harvest <strong>in</strong><strong>for</strong>mation<br />

on a transactional bas<strong>is</strong> even <strong>for</strong> seem<strong>in</strong>gly simple wood products requires a tremendous<br />

amount of data to be submitted to the U.S. Government. These subm<strong>is</strong>sions are costly <strong>and</strong><br />

adm<strong>in</strong><strong>is</strong>tratively burdensome <strong>for</strong> both importers <strong>and</strong> the U.S. Government while achiev<strong>in</strong>g little<br />

to prevent illegal logg<strong>in</strong>g. It <strong>is</strong> <strong>IKEA</strong>’s op<strong>in</strong>ion that, <strong>in</strong> its current <strong>for</strong>m, the Import Declaration<br />

process <strong>is</strong> unsusta<strong>in</strong>able long term <strong>and</strong> not the best use of resources <strong>in</strong> the prevention of illegal<br />

logg<strong>in</strong>g. <strong>IKEA</strong> suggests that Congress consider alternative means of provid<strong>in</strong>g declaration<br />

<strong>in</strong><strong>for</strong>mation <strong>and</strong> we would be will<strong>in</strong>g to have further d<strong>is</strong>cussions on th<strong>is</strong> po<strong>in</strong>t to identify the best<br />

alternatives to meet the needs of stakeholders <strong>in</strong> the bus<strong>in</strong>ess, environmental <strong>and</strong> en<strong>for</strong>cement<br />

communities.<br />

The potential requirement of a Lacey Declaration <strong>for</strong> composite wood products (such as particle<br />

board <strong>and</strong> fiberboard) <strong>in</strong> the future makes the requirement even more untenable because<br />

composite wood products are generally made of byproducts such as sawdust, scraps, <strong>and</strong> other<br />

remnants from other manufactur<strong>in</strong>g processes <strong>and</strong> there<strong>for</strong>e have a broad spectrum as to the<br />

potential genus, species, <strong>and</strong> countries of orig<strong>in</strong>. While th<strong>is</strong> type of materials reuse <strong>is</strong> positive<br />

from a recycl<strong>in</strong>g <strong>and</strong> susta<strong>in</strong>ability perspective, it makes collection of useful data <strong>for</strong> the<br />

declaration requirement virtually impossible. <strong>IKEA</strong> also believes that the declaration<br />

requirement should not apply to composite products until it <strong>is</strong> determ<strong>in</strong>ed that it <strong>is</strong> feasible,<br />

practical <strong>and</strong> effective to gather such <strong>in</strong><strong>for</strong>mation. However, we would like to underl<strong>in</strong>e that th<strong>is</strong><br />

should not <strong>in</strong> any way reduce the responsibility of the importer to exerc<strong>is</strong>e due care <strong>in</strong><br />

procurement.<br />

Due Process<br />

The heart of the Lacey Act Amendments <strong>is</strong> the prohibition aga<strong>in</strong>st the importation of products<br />

conta<strong>in</strong><strong>in</strong>g illegally-harvested wood or plant material, which the U.S. Department of Justice <strong>and</strong><br />

the F<strong>is</strong>h <strong>and</strong> Wildlife Service en<strong>for</strong>ce through crim<strong>in</strong>al <strong>and</strong> civil penalties <strong>and</strong> seizure <strong>and</strong><br />

<strong>for</strong>feiture of merch<strong>and</strong><strong>is</strong>e. To avoid possible civil <strong>and</strong> crim<strong>in</strong>al penalties, importers must exerc<strong>is</strong>e<br />

proper due diligence <strong>in</strong> their supply cha<strong>in</strong>s to ensure their products do not conta<strong>in</strong> illegallyharvested<br />

wood or plant material.<br />
