The court found that while organic
chicken practices “may be commendable
but it does not change the fact that the
product is chicken.”
The court considered it important that the
organic producer “will not be required to
reduce his level of production; he will
simply be required to pay permit fees and
levies comparable to those of the other
organic chicken producer.” The court did
acknowledge that the Board could “decide
on practical transitional arrangements for
bringing organic chicken producers into
full compliance with the marketing
regime.”
