IV. CONCLUSION
The Court concludes that Plaintiffs’ federal claim for nuisance is barred by the political
question doctrine and for lack of standing under Article III. Accordingly,
IT IS HEREBY ORDERED THAT Defendants’ motions to dismiss for lack of
jurisdiction are GRANTED. The remaining motions to dismiss are DENIED as moot.
Plaintiffs’ state law claims are dismissed without prejudice to refiling in state court. The Clerk
shall close the file and terminate all pending matters.
IT IS SO ORDERED.
