Mock Trial Competition<br />
Logos Wins <strong>State</strong> Heads to Nationals in Oklahoma<br />

Logos Secondary School (plaintiff) won the <strong>Idaho</strong> Law<br />
Foundation <strong>State</strong> Mock Trial Competition on March 15, by defeating<br />
Kimberly High School (defense) during the final round at the<br />
<strong>Idaho</strong> Supreme Court.<br />
<strong>The</strong> Honorable Linda Copple Trout, who presided over the<br />
final round in Boise, announced the performance decision and that<br />
the defendant, Pat Cartwright, was 50 percent liable for injuries sustained<br />
by Jamie Franklyn in a fire on property owned by<br />
Cartwright. Students who orchestrated the illegal bar and casino<br />
were held to each be 25 percent at fault. Justice Trout and fellow<br />
panel judges Honorable Larry Boyle, chief magistrate judge, U.S.<br />
District Court and Russ Heller, Boise School District administrator<br />
commended the students for their poise and presentation.<br />
Students competing from Logos (Moscow) included: Samuel<br />
Dickison, Jeremiah Grauke, Heather Hagen, Cecilia Hui, Laurel<br />
McGarry, Danny Ryan, Justin Spencer, and Vicky Trochez.<br />
Students competing from Kimberly included: Emily Clements,<br />
Ashley Evans, Shiann Johns, Edie Jones, McKay Nield, Morgan<br />
Price, Kelly Stout, Jamie Thomas, and Kelsey Yung.<br />
At the semi-final competition held earlier in the day, Lake City<br />
(Coeur d’Alene) and another Logos team placed third and fourth<br />
respectively.<br />
<strong>The</strong> teams argued a civil case, Franklyn v. Cartwright. Franklyn<br />
is a student who is burned in a fire that happens in a barn owned<br />
by Cartwright. Cartwright rented the barn to two high school students<br />
who were supposedly storing equipment for their summer<br />
lawn business in the barn. Instead, the enterprising students open a<br />
bar and casino in the barn. It is during a night when students are<br />
gathered to game and drink that the fire occurs. Franklyn is badly<br />
burned by the fire that was caused by faulty electrical wiring inside<br />
the barn. <strong>The</strong> barn owner’s defense is that he had no knowledge<br />
that his barn was being used for a purpose other than the one he<br />
agreed to when he rented it to the two young men. Although the<br />
fact pattern has obvious criminal issues, students were asked to consider<br />
solely the civil liability of the defendant, Pat Cartwright.<br />
<strong>The</strong> final round of the state competition was the culmination<br />
of a month-long season of regional competitions, and a preliminary<br />
and semi-final round at the state level. Thirty-six teams, con-<br />
sisting of 320 students, participated in the competition statewide.<br />
Twelve teams advanced from their regions to participate at state.<br />

<strong>The</strong> students from Logos participated in the national competition<br />
on May 10-12, <strong>2006</strong>, in Oklahoma City. <strong>The</strong> second place team<br />
from Kimberly was invited to participate in the American Mock<br />
Trial Invitational and traveled to North Carolina on May 15-17.<br />
Exciting news! Our <strong>Idaho</strong> Logos students placed<br />
ninth out of 46 teams at the national competition held<br />
in Oklahoma. <strong>The</strong>y received a trophy for placing in the<br />
top ten. <strong>The</strong> only round they lost was to the Iowa team<br />
who ended up winning the national championship. This<br />
is the highest a team from <strong>Idaho</strong> has ever placed.<br />
