Both hypo<str<strong>on</strong>g>the</str<strong>on</strong>g>ses tested with survey data and three-strikes case informati<strong>on</strong> from San Diego County indicate that prosecutors are not using <str<strong>on</strong>g>the</str<strong>on</strong>g>ir discreti<strong>on</strong>ary authority to strike a strike in a disparate manner nor are <str<strong>on</strong>g>the</str<strong>on</strong>g>y striking prior strikes based <strong>on</strong> extra-legal factors. Although race data was not made available for this analysis, <str<strong>on</strong>g>the</str<strong>on</strong>g> str<strong>on</strong>g performance <str<strong>on</strong>g>of</str<strong>on</strong>g> crime c<strong>on</strong>trol variables in this study supports <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong> that prosecutors are in fact using <str<strong>on</strong>g>the</str<strong>on</strong>g>ir allowable discreti<strong>on</strong> in a manner that reinforces <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <str<strong>on</strong>g>the</str<strong>on</strong>g>oretical crime c<strong>on</strong>trol perspective. 37
