The SIB’s board <strong>of</strong> directors declared early on <strong>in</strong><br />

<strong>the</strong> formation process that <strong>the</strong> preponderance <strong>of</strong><br />

<strong>the</strong> bank’s operations would take place accord<strong>in</strong>g<br />

to <strong>the</strong> <strong>Islamic</strong> f<strong>in</strong>ancial <strong>in</strong>struments <strong>of</strong> musharaka<br />

and mudaraba, <strong>the</strong> two forms <strong>of</strong> partnership<br />

f<strong>in</strong>anc<strong>in</strong>g most highly encouraged by <strong>Islamic</strong> law<br />

(El-Bhasri and Adam, 1997, p. 14).<br />

These <strong>in</strong>struments, which are roughly equivalent<br />

to <strong>the</strong> venture capital process <strong>in</strong> conventional<br />

bank<strong>in</strong>g, spread <strong>the</strong> risk <strong>in</strong>volved equitably among<br />

<strong>the</strong> partners <strong>in</strong>volved. Under mudaraba, or<br />

trustee pr<strong>of</strong>it shar<strong>in</strong>g, <strong>the</strong> f<strong>in</strong>anc<strong>in</strong>g partner, who is<br />

<strong>the</strong> supplier <strong>of</strong> capital, enters <strong>in</strong>to contractual<br />

agreement with <strong>the</strong> entrepreneurial partner, who<br />

is <strong>the</strong> supplier <strong>of</strong> <strong>the</strong> entrepreneurial expertise.<br />

Both agree to share pr<strong>of</strong>its accord<strong>in</strong>g to an agreed<br />

upon percentage. Under musharaka, or jo<strong>in</strong>t<br />

venture pr<strong>of</strong>it shar<strong>in</strong>g, both <strong>the</strong> <strong>Islamic</strong> bank and<br />

<strong>the</strong> entrepreneur enter a contract with capital<br />

contributions. Fur<strong>the</strong>rmore:<br />

musharaka, is a form <strong>of</strong> jo<strong>in</strong>t venture<br />

between <strong>Islamic</strong> Banks and<br />

[entrepreneurs]…<strong>in</strong> which both partners<br />

contribute to capital <strong>in</strong> <strong>the</strong> form <strong>of</strong> fixed<br />

assets or operat<strong>in</strong>g expenses, and share<br />

pr<strong>of</strong>its and losses <strong>in</strong> specific ratios, fixed<br />

before <strong>the</strong> start <strong>of</strong> <strong>the</strong> operations. It also<br />

<strong>in</strong>cludes self-liquidat<strong>in</strong>g arrangements<br />

(dim<strong>in</strong>ish<strong>in</strong>g musharaka or partnership)<br />

through which <strong>the</strong> full ownership <strong>of</strong> assets<br />

passes to <strong>the</strong> partner after a certa<strong>in</strong><br />

period. In this last form, <strong>the</strong> partner uses<br />

some <strong>of</strong> his pr<strong>of</strong>its systematically to buy a<br />

certa<strong>in</strong> ratio <strong>of</strong> <strong>the</strong> bank’s share <strong>in</strong> <strong>the</strong><br />

fixed assets….To ensure compliance with<br />

<strong>the</strong> contract, <strong>the</strong> bank undertakes <strong>the</strong><br />

general supervision and monitor<strong>in</strong>g <strong>of</strong> <strong>the</strong><br />

progress <strong>of</strong> <strong>the</strong><br />

operations….Management <strong>of</strong> <strong>the</strong> project<br />

is a sole responsibility <strong>of</strong> <strong>the</strong><br />

[entrepreneurial] partner….Losses due to<br />

negligence are to be borne by <strong>the</strong><br />

[entrepreneurial] partner alone (Ibrahim,<br />

1997, p. 3).<br />

Of <strong>the</strong> two forms <strong>of</strong> <strong>Islamic</strong> partnership,<br />

musharaka is used more <strong>of</strong>ten as a tool <strong>of</strong><br />

f<strong>in</strong>ancial <strong>in</strong>termediation by SIB. In fact, by 1987,<br />

61% <strong>of</strong> <strong>the</strong> bank’s <strong>in</strong>termediation activity was<br />

based on musharaka (Harper, 1994, p. 4).<br />

SIB AND MICROFINANCE INTERMEDIATION<br />

SIB cont<strong>in</strong>ued to expand its use <strong>of</strong> musharaka as<br />

it <strong>in</strong>creased its socioeconomic responsibility <strong>in</strong><br />

development through <strong>the</strong> <strong>in</strong>vestment <strong>in</strong><br />

microenterprise. In fur<strong>the</strong>r demonstrat<strong>in</strong>g its<br />

leadership <strong>in</strong> socioeconomic responsibility, SIB<br />

became “<strong>the</strong> first bank <strong>in</strong> <strong>Sudan</strong> to <strong>in</strong>itiate and<br />

open family-specific branches <strong>in</strong> <strong>the</strong> urban<br />

residential areas to extend capital to small<br />

enterprises” (Ibrahim, 1997, p. 6). The first<br />

family-specific branch <strong>of</strong> SIB was opened <strong>in</strong><br />

Omdurman <strong>in</strong> May <strong>of</strong> 1992. S<strong>in</strong>ce <strong>the</strong>n, SIB has<br />

opened six additional family-specific branches<br />

(Ibrahim, p. 6). These six additional branches<br />

<strong>in</strong>clude one opened <strong>in</strong> <strong>the</strong> town <strong>of</strong> Wad Medani,<br />

180 km south <strong>of</strong> <strong>the</strong> capital city <strong>of</strong> Khartoum, and<br />

a branch opened to cater to <strong>the</strong> Mulazm<strong>in</strong> and<br />

Bait-al-mal districts <strong>of</strong> Omdurman. The<br />

rema<strong>in</strong><strong>in</strong>g four branches were opened <strong>in</strong> o<strong>the</strong>r<br />

parts <strong>of</strong> Khartoum and <strong>in</strong> <strong>the</strong> rural area (Ibrahim,<br />

p. 6).<br />

To implement its policy <strong>of</strong> socioeconomic<br />

responsibility, SIB developed <strong>the</strong> concept <strong>of</strong> <strong>the</strong><br />

“productive family.” A productive family is<br />

def<strong>in</strong>ed <strong>in</strong> both social and economic terms. The<br />

follow<strong>in</strong>g captures <strong>the</strong> essence <strong>of</strong> <strong>the</strong> productive<br />

family:<br />

<strong>in</strong>cludes <strong>the</strong> extended family <strong>of</strong> men and<br />

women who have talents, experience and<br />

<strong>the</strong> will to pursue…economic activity both<br />

<strong>in</strong> production and service…for <strong>the</strong><br />

purpose <strong>of</strong> provid<strong>in</strong>g goods and services<br />

for local <strong>in</strong>habitants and <strong>in</strong>creas<strong>in</strong>g<br />

<strong>in</strong>comes to meet <strong>the</strong>…basic<br />

requirement[s] <strong>of</strong> <strong>the</strong> target group….The<br />

def<strong>in</strong>ition <strong>of</strong> <strong>the</strong> family economic activity<br />

<strong>in</strong>cludes production or services….The<br />

enterprises covered…are generally<br />

thought to show similar characteristics,<br />

such as ease <strong>of</strong> entry, labour-<strong>in</strong>tensive;<br />

small-scale; reliance on <strong>in</strong>digenous<br />

resources; adaptive technology and skills<br />

acquired outside <strong>the</strong> formal school system<br />

(Ibrahim, 1997, p. 6).<br />

The aims <strong>of</strong> <strong>the</strong> SIB <strong>in</strong> establish<strong>in</strong>g <strong>the</strong> familyspecific<br />

branches are <strong>in</strong>tended to contribute to<br />

<strong>the</strong> realization <strong>of</strong> maqasid as-Shari’ah, that is, <strong>the</strong><br />

socioeconomic goals <strong>of</strong> <strong>Islamic</strong> law. These aims<br />

<strong>in</strong>clude <strong>the</strong> follow<strong>in</strong>g:<br />
