4. Release and Covenant Not to Sue: The undersigned hereby releases and covenants not to sue SFS, its
owners, shareholders, directors, coaches, employees, representatives, agents, and lessees from any and all
claims resulting from: i) the inherent risks of use of the facilities and equipment of Summit Fitness and
Sports (SFS) including but not limited to any loss, injury, damage or liability sustained while on or
about the premises of Summit Fitness and Sports (SFS), and ii) the negligence or intentional acts of
parties other than SFS.
5. Indemnification: The undersigned shall defend, indemnify, and hold SFS, its officers, employees, and
agents harmless from and against any and all liability, loss, expense, including reasonable attorney's fees,
claims from injury or damages to the extent that the same are caused by or result from the negligence or
the intentional acts or omissions of third parties or of an individual or group renting space from the
facility, its officers, agents or employees.
The undersigned has read, understood this waiver, release and indemnity form, and acknowledges that he/she is
freely entering into the above waiver and release, understanding that he/she has given up substantial rights by
signing it and is, nonetheless signing voluntarily under no duress or time constraints. The undersigned has been
given an opportunity to speak with a representative of SFS to discuss any questions he/she might have. Without
limiting the generality of the foregoing, it is the undersigned's intention on his or her own behalf, and/or on behalf of
his/her minor child, to specifically release and indemnify SFS from any liabilities, losses, damages, settlements,
claims, expenses and costs arising from his/her, or his/her child's participation in the desired activity as described in
the preceding paragraphs, said indemnity to include reimbursement of SFS's court costs and reasonable attorney's fees.

Photography Release Waiver
I, hereby grant Summit Fitness and Sports, LLC the irrevocable right and unrestricted permission to
use, distribute, modify, publish and create derivative works of photographs or video images of me, or
members of my family, or in which I may be included, for any purpose determined by Summit Fitness
and Sports, LLC in its sole discretion, including but not limited to: print, website use, social media,
editorial publications and advertising use. This grant includes the right to modify and retouch the
images in the discretion of Summit Fitness and Sports, LLC. I understand that the circulation of such
materials could be worldwide and that there will be no compensation to me for this use. Furthermore,
I understand that I will not be given the opportunity to inspect or approve the finished products or the
advertising copy or the printed matter that may be used in connection therewith. In granting this
permission to Summit Fitness and Sports, LLC, I am fully and without limitation releasing it from any
liability that may arise from the use of the images.
