The EPA establishes <strong>the</strong> requirement for EIAs in Guyana.<br />

Part IV c<strong>on</strong>tains provisi<strong>on</strong>s regulating EIAs. Under this<br />

Part, s.11, any developer whose project falls within <strong>the</strong><br />

classes <strong>of</strong> projects listed in <strong>the</strong> fourth schedule or any o<strong>the</strong>r<br />

project that may significantly affect <strong>the</strong> envir<strong>on</strong>ment, is<br />

required to apply to <strong>the</strong> Envir<strong>on</strong>mental Protecti<strong>on</strong> Agency<br />

(referred to as “Agency”) for an Envir<strong>on</strong>mental Permit.<br />

Secti<strong>on</strong> 10 <strong>of</strong> <strong>the</strong> EPA defines EIA as an assessment as<br />

provided for under Part IV <strong>of</strong> <strong>the</strong> Act.<br />

There is a prescribed form that an applicant seeking an<br />

Envir<strong>on</strong>mental Permit must submit al<strong>on</strong>g with specific<br />

informati<strong>on</strong>. This includes informati<strong>on</strong> <strong>on</strong><br />

• <strong>the</strong> site, design and size <strong>of</strong> <strong>the</strong> project;<br />

• possible effects <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment;<br />

• <strong>the</strong> durati<strong>on</strong> <strong>of</strong> <strong>the</strong> project; and<br />

• a n<strong>on</strong>-technical explanati<strong>on</strong> <strong>of</strong> <strong>the</strong> project.<br />

In <strong>the</strong> case where it is not clear whe<strong>the</strong>r a project will<br />

significantly affect <strong>the</strong> envir<strong>on</strong>ment, <strong>the</strong> developer must<br />

submit a summary <strong>of</strong> <strong>the</strong> project to <strong>the</strong> Agency, c<strong>on</strong>taining<br />

<strong>the</strong> same informati<strong>on</strong> as in <strong>the</strong> case <strong>of</strong> an applicati<strong>on</strong> for<br />

an Envir<strong>on</strong>mental Permit. For this class <strong>of</strong> projects, <strong>the</strong><br />

Agency decides whe<strong>the</strong>r to exempt <strong>the</strong> project from having<br />

to undertake, or it may require it to do so, in which case it<br />

must place a public notice in a local daily newspaper.<br />

Where <strong>the</strong> Agency exempts a project o<strong>the</strong>r than under<br />

s.11(3) any pers<strong>on</strong> who may be affected by that project<br />

has <strong>the</strong> right <strong>of</strong> appeal against <strong>the</strong> decisi<strong>on</strong> <strong>of</strong> <strong>the</strong> Agency.<br />

The legislati<strong>on</strong> prescribes <strong>the</strong> procedures for <strong>the</strong> appeal<br />

which must be made to Envir<strong>on</strong>mental Assessment Board<br />

(EAB).<br />

The EPA stipulates that <strong>on</strong>ly an independent and<br />

suitably qualified pers<strong>on</strong> approved by <strong>the</strong> Agency can carry<br />

out an EIA*. The legislati<strong>on</strong> establishes <strong>the</strong> procedures for<br />

undertaking EIAs and <strong>the</strong> c<strong>on</strong>tents <strong>of</strong> <strong>the</strong> EIA Report<br />

(statement). Secti<strong>on</strong> 11 (4) specifies what pers<strong>on</strong>s<br />

c<strong>on</strong>ducting EIAs must c<strong>on</strong>sider and s.11(5) details what<br />

EIAs must c<strong>on</strong>tain.<br />

Pers<strong>on</strong>s undertaking EIAs are required to identify,<br />

describe and evaluate <strong>the</strong> direct and indirect effects <strong>of</strong><br />

<strong>the</strong> proposed project <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment. The legislati<strong>on</strong><br />

lists those envir<strong>on</strong>mental receptors that must be assessed<br />

such as human beings; flora and fauna and species habitat;<br />

water; soil; air and climatic factors; material assets, <strong>the</strong><br />

cultural heritage and <strong>the</strong> landscape; natural resources; and<br />

<strong>the</strong> ecological balance between ecosystems.<br />

Under s.11(5) every EIA must c<strong>on</strong>tain:<br />

• a descripti<strong>on</strong> <strong>of</strong> <strong>the</strong> project (locati<strong>on</strong>, producti<strong>on</strong><br />

processes, emissi<strong>on</strong>s, etc.);<br />

• an outline <strong>of</strong> <strong>the</strong> main alternatives;<br />

• a descripti<strong>on</strong> <strong>of</strong> likely significant effects;<br />

• an indicati<strong>on</strong> <strong>of</strong> difficulties (technical, expertise,<br />

knowledge, etc.) encountered during <strong>the</strong> study;<br />

• descripti<strong>on</strong> <strong>of</strong> best available technology;<br />

• descripti<strong>on</strong> <strong>of</strong> any hazards or dangers which may<br />

arise from <strong>the</strong> project and an assessment <strong>of</strong> <strong>the</strong><br />

risk to <strong>the</strong> envir<strong>on</strong>ment;<br />

• a descripti<strong>on</strong> <strong>of</strong> mitigati<strong>on</strong> measures;<br />

• a statement <strong>of</strong> <strong>the</strong> degree <strong>of</strong> irreversible damage;<br />

• an emergency resp<strong>on</strong>se plan;<br />

• a rehabilitati<strong>on</strong> and restorati<strong>on</strong> programme; and<br />

• a n<strong>on</strong>-technical summary <strong>of</strong> <strong>the</strong> informati<strong>on</strong>.<br />

The Agency is compelled to publish a notice <strong>of</strong> <strong>the</strong><br />

proposal in a daily newspaper, at <strong>the</strong> expense <strong>of</strong> <strong>the</strong><br />

developer, before <strong>the</strong> EIA starts. Members <strong>of</strong> <strong>the</strong> public<br />

have a specified time period (28 days) within which to<br />

make written submissi<strong>on</strong>s to <strong>the</strong> Agency asking questi<strong>on</strong>s<br />

and raising matters to be c<strong>on</strong>sidered by <strong>the</strong> EIA. There<br />

is no qualificati<strong>on</strong> in <strong>the</strong> legislati<strong>on</strong> indicating which<br />

members <strong>of</strong> <strong>the</strong> public have a right to make submissi<strong>on</strong>s.<br />

The Agency is resp<strong>on</strong>sible for developing <strong>the</strong> Terms <strong>of</strong><br />

Reference (TORs) and scope <strong>of</strong> <strong>the</strong> EIA and must c<strong>on</strong>sult<br />

with <strong>the</strong> developer before doing so and must c<strong>on</strong>sider<br />

submissi<strong>on</strong>s made by <strong>the</strong> public.<br />

The EPA under s.12 authorises <strong>the</strong> Agency to approve<br />

or reject <strong>the</strong> project after c<strong>on</strong>sidering a number <strong>of</strong> factors<br />

including public submissi<strong>on</strong>s, <strong>the</strong> recommendati<strong>on</strong>s <strong>of</strong><br />

<strong>the</strong> Envir<strong>on</strong>mental Assessment Board and <strong>the</strong> EIA and<br />

Envir<strong>on</strong>mental Impact Statement (EIS). The Act requires<br />

<strong>the</strong> Agency to publish its decisi<strong>on</strong> and <strong>the</strong> grounds for<br />

making that decisi<strong>on</strong>.<br />

Under s.13 <strong>the</strong> Agency stipulates that a decisi<strong>on</strong> by <strong>the</strong><br />

Agency to grant an envir<strong>on</strong>mental permit shall be subject<br />

to a number <strong>of</strong> statutory c<strong>on</strong>diti<strong>on</strong>s. The Agency has a<br />

statutory duty not to issue an envir<strong>on</strong>mental permit unless<br />

it is satisfied that <strong>the</strong> developer can comply with <strong>the</strong> terms<br />

and c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> <strong>the</strong> permit and that <strong>the</strong> developer can<br />

pay compensati<strong>on</strong> for any loss or damage which may<br />

arise from <strong>the</strong> project or a breach <strong>of</strong> any <strong>of</strong> <strong>the</strong> terms and<br />

c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> <strong>the</strong> permit.<br />

The envir<strong>on</strong>mental permit takes precedence over<br />

o<strong>the</strong>r development c<strong>on</strong>sents. The EPA (s.14) prohibits<br />

o<strong>the</strong>r public agencies resp<strong>on</strong>sible for issuing development<br />

c<strong>on</strong>sents in relati<strong>on</strong> to matters where an envir<strong>on</strong>mental<br />

authorisati<strong>on</strong> is needed, from so doing unless such<br />
