Assualts at C-Max Prison

Accordingly, the Commission recommends that:
6.16.1 Mr Kutumela be charged with contravening Clause 2.1 Column A
of the Department’s Disciplinary Code – Gross negligence.
6.16.2 Mr Kutumela also be charged with perjury.
7. GENERAL RECOMMENDATIONS
The Commission recommends that:
7.1 The Head of Prison at Pretoria C-Max Prison should ensure that a
proper electric shield register is kept in which the issuing of the shields to
members is properly registered.
7.2 Further recommendations with regard to the admission of prisoners and
the existence of C-Max Prison are made in the chapter on Treatment of
Prisoners.
7.3 For the reasons stated in the previous interim reports already filed,
disciplinary inquiries against the members referred to in this report
should be conducted by a Special Task Team contemplated by the
Commission.
8. CONCLUSION
The treatment of prisoners at Pretoria C-Max Prison upon admission is a clear
indication that the members of the Department have no respect for prisoners’
human rights. Evidence has established that prisoners are assaulted for no
apparent reason upon admission. This treatment is normally referred to as an
initiation process. Prisoners at Pretoria C-Max have already been sentenced by
courts of law and there is no need for further punishment on admission. This is
