Complet<strong>in</strong>g the OGE Form 450 Report. Those who are designated as filers are required<br />

to make their disclosure <strong>in</strong> FDM on the OGE Form 450 not later than February 15th<br />

of each year unless they are granted a fil<strong>in</strong>g extension. Filers may not beg<strong>in</strong> work<strong>in</strong>g on<br />

their next report <strong>in</strong> FDM until January 1, 2014. For those <strong>in</strong>dividuals designated as OGE<br />

Form 450 filers, it is important to know that, as the name suggests, their fil<strong>in</strong>gs are confidential.<br />

Only the filer’s supervisor and the organization’s Ethics Counselor are able to review<br />

the disclosures. Those two <strong>in</strong>dividuals have responsibility for ensur<strong>in</strong>g the technical correctness<br />

of the report and assess<strong>in</strong>g whether a filer’s personal f<strong>in</strong>ancial <strong>in</strong>terests or affiliations<br />

pose an actual or potential conflict of <strong>in</strong>terest with the filer’s official duties. Where there is a<br />

potential or actual conflict based on particular hold<strong>in</strong>gs, the filer must either remove the conflict<strong>in</strong>g<br />

hold<strong>in</strong>g (e.g., by sell<strong>in</strong>g those particular shares of stock) or be prohibited from tak<strong>in</strong>g<br />

any official action that might affect that hold<strong>in</strong>g.<br />

Take as a common example the <strong>in</strong>dividual civil servant who performs work that <strong>in</strong>volves<br />

award<strong>in</strong>g, adm<strong>in</strong>ister<strong>in</strong>g, and modify<strong>in</strong>g government contracts to those who provide goods<br />

and services to the Department of the <strong>Army</strong>. Because of the significant judgment exercised<br />

without substantial supervisory review, this particular position has been designated as a<br />

“fil<strong>in</strong>g” position, mean<strong>in</strong>g the <strong>in</strong>cumbent must annually receive ethics tra<strong>in</strong><strong>in</strong>g and file the<br />

OGE Form 450. Disclosure might <strong>in</strong>clude that the <strong>in</strong>cumbent has personal hold<strong>in</strong>gs <strong>in</strong> a<br />

DoD contractor. The OGE 450 won’t <strong>in</strong>dicate how many shares are owned or their value,<br />

but it will identify the <strong>in</strong>terest at stake. The filer’s supervisor (along with his ethics counselor),<br />

who knows the filer’s <strong>in</strong>dividual responsibilities, must then review the fil<strong>in</strong>g for actual<br />

or potential conflicts of <strong>in</strong>terest. If that person might be <strong>in</strong> a position to take official action<br />

<strong>in</strong>volv<strong>in</strong>g the DoD contractor, there is the requirement to divest or refra<strong>in</strong> from tak<strong>in</strong>g action.<br />
