<strong>ACT</strong> KANGAROO MANAGEMENT PLAN<br />

2.2 Categories of l<strong>and</strong> in the <strong>ACT</strong><br />

The kangaroo management plan aims to present a holistic approach to management of wild<br />

kangaroo populations across all l<strong>and</strong> in the <strong>ACT</strong>, providing guidance to relevant l<strong>and</strong> managers.<br />

The three main categories of l<strong>and</strong> in the <strong>ACT</strong> relevant to this plan are:<br />

· <strong>Territory</strong> L<strong>and</strong> managed by the <strong>ACT</strong> Government<br />

· National L<strong>and</strong> managed by the Commonwealth Government<br />

· Leased <strong>Territory</strong> L<strong>and</strong> managed by individual <strong>and</strong> institutional l<strong>and</strong> holders.<br />

The plan is also relevant to the Googong Dam Area (Googong Foreshores) which is Commonwealth<br />

l<strong>and</strong> in New South Wales, leased to <strong>and</strong> managed by the <strong>ACT</strong> Government.<br />

These categories are briefly outlined below.<br />

2.2.1 <strong>Territory</strong> L<strong>and</strong> managed by the <strong>ACT</strong> Government<br />

a) Public L<strong>and</strong>: This is established under the <strong>Plan</strong>ning <strong>and</strong> Development Act 2007 (Chapter 10 of<br />

the Act). The Act (Schedule 3) sets out management objectives for the different categories of<br />

Public L<strong>and</strong>. These categories are: wilderness area, national park, nature reserve, special purpose<br />

reserve, urban open space, cemetery or burial ground, protection of water supply, lake, sport <strong>and</strong><br />

recreation reserve, <strong>and</strong> heritage area.<br />

Areas of Public L<strong>and</strong> are defined in the <strong>Territory</strong> <strong>Plan</strong> (Volume 1) (<strong>ACT</strong> Government 2008).<br />

b) Other <strong>ACT</strong> Government managed l<strong>and</strong>: This is l<strong>and</strong> not classified as Public L<strong>and</strong> but still<br />

managed by the <strong>ACT</strong> Government. It includes existing <strong>and</strong> former commercial pine plantation<br />

areas (some of which, e.g. lower Cotter Catchment, is now Public L<strong>and</strong> (protection of water<br />

supply)), unleased rural l<strong>and</strong> <strong>and</strong> urban open space, some horse paddock areas, <strong>and</strong> specific<br />

purpose sites outside the urban area.<br />

2.2.2 National L<strong>and</strong> managed by the Commonwealth<br />

Government<br />

This is l<strong>and</strong> in the <strong>ACT</strong> retained by the Commonwealth <strong>and</strong> managed by, or the responsibility<br />

of, Commonwealth Government agencies. Examples are Belconnen Naval Transmitting Station<br />

<strong>and</strong> Majura Training Area (Department of Defence), <strong>and</strong> areas around Lake Burley Griffin such<br />

as Stirling Ridge (National Capital Authority) <strong>and</strong> Government House, Yarralumla (Office of the<br />

Official Secretary to the Governor-General).<br />

Section 27 of the Australian Capital <strong>Territory</strong> (Self-Government) Act 1988, specifies that the Crown<br />

in right of the Commonwealth shall not be bound by an enactment of the Legislative Assembly<br />

for the Australian Capital <strong>Territory</strong> unless a regulation made under the Act provides otherwise.<br />

The Australian Capital <strong>Territory</strong> (Self-Government) Regulations (Commonwealth) identify the<br />

Nature Conservation Act 1980 as a law of the territory that does bind the Crown in right of the<br />

Commonwealth. The provisions of the Environment Protection <strong>and</strong> Biodiversity Conservation Act<br />

1999 (Cwlth) also apply to National L<strong>and</strong>. The kangaroo management plan aims to provide guidance<br />

for management of kangaroo populations on National L<strong>and</strong>; however, adoption of its provisions is<br />

at the discretion of the relevant Commonwealth l<strong>and</strong> managers. <strong>Kangaroo</strong> management actions<br />

may require a licence under the Nature Conservation Act, therefore the <strong>ACT</strong> Government has<br />

some influence over actions that may be taken by the managers of National L<strong>and</strong>.<br />
