NOTIFICATION<br />

It is notified for general information that Form TM-1, must be completed<br />

in all respects and informations asked for must be provided. Instructions for<br />

Completions of TM-1, given on this form in the Rules should be followed. The<br />

instruction at (f) and (g) relating to user and signature are clear and<br />

noncompliance leads to over work for the Trade Marks Registry and un-necessary<br />

delay for the Applicants. Incomplete forms will not be received, and if received<br />

by POST will not be examined at their turn, till they are complete in all respects.<br />

EXTENSION OF TIME<br />

2. It has been observed that in opposition and Rectification cases, both the<br />

parties or their Agents/Advocates make requests on Form TM-56 for Extension of<br />

time, which are liberally granted to the parties. This practice not only delays the<br />

disposal of cases, but also results in accumulation of work. In order to discourage<br />

this practice, it is notified for general information that no unnecessary extension<br />

of time will be allowed except substantiated by cogent and convincing reasons<br />

and that mere collection of data or compilation of paper would not be sufficient<br />

reasons for asking such extension. All concerned should note and cooperate for<br />

early disposal of contested cases. Besides requests for extension of time in<br />

opposition cases must be accompanied by valid power of authorization, without<br />

which such requests are liable to be treated as un-authorized.<br />

AU<strong>THE</strong>NTICATION OF FOREIGN DOCUMENTS AND POWER OF ATTORNEY.<br />

3. It is notified for general information that all Foreign Documents and the<br />

Power of Attorneys shall be executed before, and authenticated by a Notary<br />

Public, or any Court, Judge, Magistrate, Consul or Vice Consul, or Representation<br />

of the Central Government as enumerated in Section 85 of the Evidence Act.<br />
