3.0 Environmental Impacts <strong>of</strong> large scale <strong>m<strong>in</strong><strong>in</strong>g</strong><br />

The later part <strong>of</strong> <strong>the</strong> year 2013 saw government <strong>of</strong> <strong>Zimbabwe</strong> suspend<strong>in</strong>g river bed <strong>m<strong>in</strong><strong>in</strong>g</strong> activities <strong>in</strong><br />

<strong>the</strong> wake <strong>of</strong> serious ecological damages to Mazowe River <strong>and</strong> Mutare River to mention but just a few.<br />

Whilst <strong>the</strong> suspension was welcome, what rema<strong>in</strong>s critical is for <strong>the</strong> government to harmonise laws that<br />

regulate <strong>m<strong>in</strong><strong>in</strong>g</strong> activities <strong>in</strong> <strong>Zimbabwe</strong> <strong>in</strong> order to close exist<strong>in</strong>g gaps that have allowed unregulated<br />

<strong>m<strong>in</strong><strong>in</strong>g</strong> practices. The current legal framework that guides operations <strong>in</strong> <strong>the</strong> <strong>m<strong>in</strong><strong>in</strong>g</strong> <strong>in</strong>dustry is not<br />

synchronised.The follow<strong>in</strong>g are some <strong>of</strong> <strong>the</strong> important acts that govern <strong>the</strong> <strong>m<strong>in</strong><strong>in</strong>g</strong> <strong>sector</strong> <strong>in</strong> <strong>Zimbabwe</strong><br />

(National Water Policy 2013).<br />

i. <strong>Zimbabwe</strong> National Water Authority(ZINWA)ZINWA Act <strong>of</strong> 1998<br />

ii. Environmental Management Agency(EMA)Act (Chapter 20:27)2002<br />

iii. M<strong>in</strong>es <strong>and</strong> m<strong>in</strong>erals Act (Chapter 21:05)1996 edition<br />

iv. Rural District Councils Act Chapter 29:13)1996 edition<br />

The m<strong>in</strong>es <strong>and</strong> m<strong>in</strong>erals act does not embody <strong>the</strong> above listed regulatory acts because <strong>the</strong>y fall under<br />

different m<strong>in</strong>istries. As a result, critical stakeholders like EMA <strong>and</strong> ZINWA are made to police <strong>the</strong><br />

environment after <strong>m<strong>in</strong><strong>in</strong>g</strong> concessions had already been issued by <strong>the</strong> m<strong>in</strong>istry <strong>of</strong> m<strong>in</strong>es. In some<br />

<strong>in</strong>stances <strong>m<strong>in</strong><strong>in</strong>g</strong> activities commence on <strong>the</strong> ground without <strong>the</strong> knowledge <strong>of</strong> rural district councils.<br />

Issuance <strong>of</strong> <strong>m<strong>in</strong><strong>in</strong>g</strong> claims depend<strong>in</strong>g on <strong>the</strong> size is done by different <strong>of</strong>fice bearers from <strong>the</strong> <strong>m<strong>in</strong><strong>in</strong>g</strong><br />

commissioner up to <strong>the</strong> President <strong>in</strong>clusive <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> Indigenisation Act that requires<br />

foreign <strong>in</strong>vestors to partner <strong>in</strong>digenous people <strong>in</strong> order to carry out <strong>m<strong>in</strong><strong>in</strong>g</strong> activities <strong>in</strong> <strong>Zimbabwe</strong>.<br />

However rampant corruption <strong>in</strong> government has also seen some bogus <strong>in</strong>vestors especially from Ch<strong>in</strong>a<br />

partner<strong>in</strong>g <strong>in</strong>digenous <strong>Zimbabwe</strong>ans to prospect <strong>and</strong> m<strong>in</strong>e without <strong>the</strong> approval <strong>of</strong> rural district<br />

councils, EMA <strong>and</strong> ZINWA.Local partners <strong>in</strong> <strong>the</strong>se <strong>m<strong>in</strong><strong>in</strong>g</strong> ventures have used <strong>the</strong>ir political <strong>in</strong>fluence to<br />

protect unscrupulous <strong>m<strong>in</strong><strong>in</strong>g</strong> practices simply because <strong>the</strong> <strong>in</strong>digenisation act guarantees <strong>the</strong>m shares<br />

out <strong>of</strong> <strong>the</strong> <strong>m<strong>in</strong><strong>in</strong>g</strong> proceeds. Under <strong>the</strong>se circumstances, several <strong>m<strong>in</strong><strong>in</strong>g</strong> projects <strong>in</strong> recent years have<br />

been undertaken sometimes <strong>in</strong> strategic water sources with devastat<strong>in</strong>g ecological results.<strong>CRD</strong> managed<br />

to capture some <strong>of</strong> <strong>the</strong>se <strong>m<strong>in</strong><strong>in</strong>g</strong> activities that have been tak<strong>in</strong>g place <strong>in</strong> Manical<strong>and</strong> prov<strong>in</strong>ce dur<strong>in</strong>g<br />

<strong>the</strong> course <strong>of</strong> <strong>the</strong> year 2013.<br />

3.1 Alluvial <strong>m<strong>in</strong><strong>in</strong>g</strong> <strong>in</strong> Penhalonga<br />

The environmental management act chapter 20 prohibits <strong>m<strong>in</strong><strong>in</strong>g</strong> activities with<strong>in</strong> 30 metres <strong>of</strong> a water<br />

course, thus <strong>m<strong>in</strong><strong>in</strong>g</strong> activities <strong>in</strong> <strong>the</strong> river is prohibited.DTZ-OZGEO was issued with a special grant by <strong>the</strong><br />

m<strong>in</strong>istry <strong>of</strong> m<strong>in</strong>es to m<strong>in</strong>e <strong>in</strong> both <strong>the</strong> river <strong>and</strong> an extensive farm<strong>in</strong>g area away from <strong>the</strong> river <strong>in</strong> direct<br />

violation <strong>of</strong> environmental laws. The company which has been <strong>m<strong>in</strong><strong>in</strong>g</strong> for over a decade was f<strong>in</strong>ally<br />

ordered to stop operations <strong>in</strong> Penhalonga by <strong>the</strong> EMA.However,<strong>CRD</strong> <strong>in</strong>terviewed company authorities<br />

soon after <strong>the</strong> grant<strong>in</strong>g <strong>of</strong> <strong>the</strong> order <strong>and</strong> realised that <strong>the</strong> measure was only temporary <strong>and</strong> <strong>m<strong>in</strong><strong>in</strong>g</strong><br />

activities would resume as soon as rehabilitation <strong>of</strong> m<strong>in</strong>ed areas has been completed. Asked on why<br />

<strong>the</strong>ir company was allowed to m<strong>in</strong>e <strong>in</strong> <strong>the</strong> river bed DTZ <strong>m<strong>in</strong><strong>in</strong>g</strong> director Mr Shillaev told <strong>CRD</strong> that gold<br />

deposits <strong>in</strong> Penhalonga were prioritised by government, moreover <strong>the</strong> company has <strong>the</strong> best technology<br />

that is environmental friendly. He went to tell <strong>CRD</strong> that <strong>the</strong>y could not rehabilitate <strong>the</strong> m<strong>in</strong>ed areas <strong>in</strong><br />

time because rehabilitation was expensive <strong>and</strong> on that account <strong>the</strong>y would need to cont<strong>in</strong>ue <strong>m<strong>in</strong><strong>in</strong>g</strong> <strong>in</strong><br />

order to f<strong>in</strong>ance <strong>the</strong> rehabilitation exercise.<br />
