Joint Opinion No. 99-100 at 1. The client’s freedom of choice in the selection of counsel is a<br />

principle firmly embedded in our Rules of Professional Conduct. Rule 1.16 (“Declining or<br />

Terminating Representation”) ethically requires a lawyer to withdraw from the representation of<br />

a client, if “the lawyer is discharged.” Comment [4] to Rule 1.16 emphasizes the point: “[a]<br />

client has a right to discharge a lawyer at any time, with or without cause, subject to liability for<br />

payment of the lawyer’s services.” ABA Formal Opinion No. 99-414 recognizes the principle as<br />

well. T<strong>here</strong>, the ABA Committee stated, “a client has the ultimate right to select counsel of his<br />

choice. . . .”<br />

This principle of client freedom of choice has also been recognized by the courts. E.g.,<br />

Adler, <strong>Bar</strong>ish, Daniels, Levin & Creskoff v. Epstein, 482 Pa. 416, 393 A.2d 1175 (1978), cert.<br />

denied and appeal dismissed, 442 U.S. 907 (1979); see also, Attorney Grievance Commission of<br />

Maryland v. Potter, 380 Md. 128, 158, 844 A.2d 367, 384 (2004) (commenting on client’s<br />

freedom of choice). 2<br />

In Potter, Maryland’s highest court stated:<br />

The client has the right to choose the attorney or attorneys who<br />

will represent it. . . . Clients are not the “possession” of anyone,<br />

but to the contrary, control who represent them. . . . Clients are not<br />

merchandise. They cannot be bought, sold or traded. The<br />

attorney-client relationship is personal and confidential, and the<br />

client’s choice of attorneys in civil cases is near absolute.<br />
