A vote by the Pennington County
Board of Commissioners on May
21, 2013 changed the minimum
acreage criteria for an agricultural
classification for property tax purposes
in Pennington County, SD.
South Dakota codified law 10-6-
31.3 lists 3 criteria required for an
agricultural property tax classification.
This law allows the county
commission to set the minimum
acreage required between 20 acres
and 160 acres. The previous minimum
acreage in Pennington
County was 40 acres. This change
will possibly affect the 2014 property
tax classification for properties
currently classified as agricultural
for property tax purposes. This is
not a zoning classification and only
affects property assessment and
taxes.
SDCL 10-6-31.3 requires any 2 of
the 3 criteria be met for an agricultural
classification. This change in
the minimum acreage will require
that agricultural classed properties
below 160 acres meet the principal
use and income criterion. Those requirements
are, in summary, that
the principal use of the property be
agricultural production for intended
profit and that one third of
the owner’s total family gross income
be derived from agricultural
production.
The office of the Pennington
County Director of Equalization
will notify, in writing, all property
owners who might be affected by
this change in classification. This
notice will be mailed in the fall of
2013 and will request information
relating to qualification for the
agricultural classification. Property
owners should expect to provide
information identifying total
owned acres, percentage of gross
income derived from agricultural
production, and principal use of the
property. This information will be
used in determining the 2014 assessment
for taxes paid in 2015.
Assessment notices mailed near
March 1, 2014 will detail the
exact property assessments and
classifications, and will include instructions
for appeal.
For questions regarding this
change or any property assessment,
please contact the Pennington
County Director of Equalization
