Cohoes City School District April 18, 2012 Board of Education Minutes Page 4 of 8 after 7/1/2012, the first payment will be deferred to a date not more than 30 days after the ERS certified retirement date. To be eligible, the employee must be a member of ERS, must be eligible to retire and receive benefits by 9/30/12 and must have been an employee of the Cohoes City School District at full-time equivalent status for a least ten years. In the event of a State Retirement Incentive offered that the Board of Education would accept, the employee must choose one. Effective: Notification must be received in the Office of the Superintendent of Schools by 4 P.M. on Tuesday, May 1, 2012 and retirement taking place no later than September 30, 2012. Furthermore, this Agreement shall not be held to have any precedential value, nor shall it constitute the establishment of a “past practice” by either party. This Memorandum of Agreement sunsets and terminates as of June 30, 2012 and shall not continue thereafter without the express written agreement of the parties. As such, this Memorandum of Agreement is expressly not subject to any extension under Triborough Amendment (Civil Service Law Section 209-a(1)(e)) or any other provision of the Civil Service Law which acts to extend the terms and conditions of an agreement at its conclusion. K. THAT the Board of Education and the Cohoes Teachers’ Association hereby enter into this Memorandum of Agreement for the purposes of correcting Article XIV(K) of the collective bargaining agreement between the two: THAT the Board of Education authorize adoption of a one time only retirement incentive for members of the New York State Teachers’ Retirement System (NYSTRS) based on the following concepts: A single payment of $20,000 payable on the first pay date in July 2012 or two installments of $11,000 each payable on the first pay date in July 2012 and the first pay date in July 2013. AND a sum equal to the (a) Number of years of service to Cohoes City School District (minimum of 10 years/maximum of 30 years) (b) Line (a) times 2.66% (c) Line (b) times 2011-2012 substitute teacher per diem payments (d) Line (c)3 times unused sick days (maximum of 275), value of unused sick leave to be retained by the School District on behalf of the retiree for health, dental and/or vision premiums; or, (e) Line (d) times 20% = Cash Payment for unused sick leave

In the event of a State Retirement Incentive offered that the Board of Education would accept, the employee must choose one. Effective: Notification must be received in the Office of the Superintendent of Schools between August 3, 2011 and April 30 February 8 10, 2012, with said notification arriving no later than 4:00 PM on Monday, April 30 Friday, February 8 10, 2012 and retirement taking place no later than October 1, 2012. This provision sunsets with the termination of this contract. Furthermore, this Agreement shall not be held to have any precedential value, nor shall it constitute the establishment of a “past practice” by either party. This Memorandum of Agreement sunsets and terminates as of June 30, 2012 and shall not continue thereafter without the express written agreement of the parties.
