(whose application for adjustment <strong>of</strong> status was based upon an<br />

approved I-129F fiancee petition) was denied on March 3, 2006 -<br />

before the decision <strong>in</strong> Freeman. Compla<strong>in</strong>t, 128. Pla<strong>in</strong>tiffs<br />

DeMailly and Gobeil, whose petition and I-485 adjustment <strong>of</strong> status<br />

applications were denied <strong>in</strong> 2003 and 2004 respectively, did not<br />

appeal the decisions, nor have they filed motions <strong>to</strong> reopen. See<br />

Compla<strong>in</strong>t, 29-34, 50-59. Pla<strong>in</strong>tiffs Vargas de Fisher and<br />

Lockett have applications that rema<strong>in</strong> pend<strong>in</strong>g with USCIS.<br />

The rema<strong>in</strong><strong>in</strong>g pla<strong>in</strong>tiffs reside outside <strong>of</strong> the jurisdiction <strong>of</strong><br />

130, 136, 142, 148. Pla<strong>in</strong>tiffs Walsh and Lu (the two pla<strong>in</strong>tiffs<br />

consular section abroad) had their I-130 petitions approved prior<br />

<strong>to</strong> the death <strong>of</strong> their spouses, but those petitions were revoked<br />

after the death <strong>of</strong> their citizen spouses. See Compla<strong>in</strong>t, 96-<br />

98, 102-04. Pla<strong>in</strong>tiffs Fishman-Corman, Arias-Argulo, Bernste<strong>in</strong>,<br />

and Bayor have not filed motions <strong>to</strong> reopen after the denial <strong>of</strong><br />

Pla<strong>in</strong>tiff Diaz-Ruiz filed a motion <strong>to</strong> reopen, which was denied <strong>in</strong><br />
