UK to face trial. You could face an 82% tax
charge which cannot be offset against a
Spanish of 43%, so there is a total charge
potentially of 125% ! The UK/Spain Double
Tax Treaty has no clear provisions allowing
the penalty taxes levied in the UK against
the transfer to be offset against the Spanish
tax liability. It may also take a while before
the UK tax problem surfaces, when you will
have paid the Spanish tax in an earlier tax
year. The Spanish tax authorities are unlikely
to re-open the earlier tax year and make any
refunds. (If you have ever tried to get a refund
from the Spanish tax authorities for overseas
tax paid in a later tax year, you will appreciate
the problem)
