Decisi<strong>on</strong> <strong>on</strong> Prosecu<strong>to</strong>r’s Moti<strong>on</strong> <strong>for</strong> Leave <strong>to</strong> Present Rebuttal 7 June 2011<br />

8. On 12 January 2011, the Defence filed “Ildeph<strong>on</strong>se Nizeyimana’s Notice of Alibi”. 6<br />

9. On 28 January 2011, Prosecuti<strong>on</strong> filed the “Prosecu<strong>to</strong>r's Urgent Sec<strong>on</strong>d Moti<strong>on</strong> <strong>for</strong><br />

Disclosure of the Particulars of a Defence of Alibi Pursuant <strong>to</strong> Rules 54 and 67(A)(ii)”. 7 The<br />

Prosecuti<strong>on</strong> argued there<strong>in</strong> that the Defence submitted <strong>in</strong>sufficient details c<strong>on</strong>cern<strong>in</strong>g its<br />

alibi. 8 The Prosecuti<strong>on</strong> requested that the Chamber order the Defence <strong>to</strong> make a number of<br />

additi<strong>on</strong>al disclosures with respect <strong>to</strong> the Accused’s alibi defence. More specifically, these<br />

<strong>in</strong>cluded: provid<strong>in</strong>g greater specificity as <strong>to</strong> the places the Accused may have been dur<strong>in</strong>g<br />

periods of absence from Butare; the date of his return <strong>to</strong> Butare from Mata; details as <strong>to</strong> how<br />

each witness appear<strong>in</strong>g <strong>in</strong> the Alibi Notice will support the alibi; other <strong>evidence</strong> which the<br />

Defence plans <strong>to</strong> rely <strong>on</strong> <strong>to</strong> support the alibi; and particulars <strong>for</strong> each witness, <strong>in</strong>clud<strong>in</strong>g their<br />

activities <strong>in</strong> 1994, parentage, birthplace, and current or 1994 residence, as well as full<br />

geographical <strong>in</strong><strong>for</strong>mati<strong>on</strong> <strong>for</strong> alibi witnesses resid<strong>in</strong>g <strong>in</strong> Rwanda. 9<br />

10. On 31 January 2011, the Defence filed a resp<strong>on</strong>se <strong>to</strong> the Sec<strong>on</strong>d Alibi Moti<strong>on</strong>, 10<br />

argu<strong>in</strong>g that the Prosecuti<strong>on</strong> should have challenged any <strong>in</strong>sufficiency <strong>in</strong> the <strong>in</strong><strong>for</strong>mati<strong>on</strong><br />

accompany<strong>in</strong>g the Alibi Notice so<strong>on</strong>er, and thus that prejudice suffered by the Prosecuti<strong>on</strong><br />

because of delay <strong>in</strong> provisi<strong>on</strong> of additi<strong>on</strong>al alibi <strong>in</strong><strong>for</strong>mati<strong>on</strong> should not be held aga<strong>in</strong>st the<br />

Accused. 11 The Sec<strong>on</strong>d Alibi Resp<strong>on</strong>se also notes that the Alibi Notice was filed as so<strong>on</strong> as<br />

the Chamber issued a protective order <strong>for</strong> relevant defence witnesses. 12 In additi<strong>on</strong>, the<br />

Resp<strong>on</strong>se provided additi<strong>on</strong>al <strong>in</strong><strong>for</strong>mati<strong>on</strong> regard<strong>in</strong>g the dates of the Accused’s travel<br />

between Mata and Butare, briefly summarises the alibi witnesses’ expected testim<strong>on</strong>y, and<br />

provides their current city and country of residence. 13<br />

11. On 1 February 2011, the Prosecuti<strong>on</strong> filed a reply <strong>to</strong> the Sec<strong>on</strong>d Alibi Resp<strong>on</strong>se. 14<br />

The Sec<strong>on</strong>d Alibi Reply submitted that the Sec<strong>on</strong>d Alibi Resp<strong>on</strong>se failed <strong>to</strong> expla<strong>in</strong> why<br />

<strong>in</strong><strong>for</strong>mati<strong>on</strong> that related <strong>to</strong> unprotected witnesses was not disclosed earlier. The Prosecuti<strong>on</strong><br />

aga<strong>in</strong> asserted that the geographical <strong>in</strong><strong>for</strong>mati<strong>on</strong> provided <strong>for</strong> Rwandan alibi witnesses was<br />
