THE PROPERTY<br />
The next part <strong>of</strong> <strong>the</strong> Agreement is a description <strong>of</strong> <strong>the</strong> property <strong>to</strong> be purchased. In most<br />
cases <strong>the</strong> property will be identified both by <strong>the</strong> street address, including <strong>the</strong> municipality,<br />
ZIP code, county, and school district, as well as by a more thorough legal description <strong>of</strong> <strong>the</strong><br />
property. If <strong>the</strong>re is any doubt or confusion about <strong>the</strong> actual location <strong>of</strong> <strong>the</strong> property or <strong>the</strong><br />
property boundaries, talk <strong>to</strong> your REALTOR ® about obtaining a survey. Many buyers are<br />
interested in living in a particular ZIP code or sending <strong>the</strong>ir children <strong>to</strong> a school in a specific<br />
school district, so both buyer and seller are encouraged <strong>to</strong> double-check this information<br />
for accuracy.<br />
WHO ARE THE BROKERS?<br />
The boxes at <strong>the</strong> bot<strong>to</strong>m <strong>of</strong> <strong>the</strong> front page <strong>of</strong> <strong>the</strong> Agreement contain information that identifies<br />
<strong>the</strong> broker or brokers who are providing real estate services in <strong>the</strong> transaction and <strong>the</strong>ir<br />
relationship(s) <strong>to</strong> <strong>the</strong> buyer and seller. It is very important that you understand <strong>the</strong> relationship<br />
you have with each broker and <strong>the</strong> legal duties that each broker owes you (or doesn’t<br />
owe you).<br />
REMEMBER: Unless you have entered in<strong>to</strong> a written agency contract creating a legal<br />
relationship between you and <strong>the</strong> broker, <strong>the</strong> broker may NOT be representing your<br />
interests and may be representing <strong>the</strong> o<strong>the</strong>r party. If you have a question about how<br />
<strong>the</strong>se relationships work, review <strong>the</strong> Consumer Notice (<strong>the</strong> first form <strong>the</strong> REALTOR ® gave<br />
you) and ask <strong>the</strong> REALTOR ® <strong>to</strong> clarify his or her role in <strong>the</strong> transaction.<br />
THIS AGREEMENT<br />
The first section <strong>of</strong> <strong>the</strong> Agreement states <strong>the</strong> date <strong>the</strong> Agreement was first presented as an<br />
<strong>of</strong>fer. The date in this paragraph is generally NOT <strong>the</strong> same as <strong>the</strong> “acceptance date,” or <strong>the</strong><br />
date a valid contract exists. This date is simply used as a convenience <strong>to</strong> identify when <strong>the</strong><br />
buyer’s <strong>of</strong>fer was first presented. This is <strong>the</strong> date that should be used as <strong>the</strong> “date <strong>of</strong> <strong>agreement</strong>”<br />
in any addenda <strong>to</strong> <strong>the</strong> Agreement.<br />
PURCHASE PRICE AND DEPOSITS<br />
The purchase price is <strong>the</strong> first <strong>of</strong> many terms stated in <strong>the</strong> Agreement. While many buyers<br />
and sellers assume that this is <strong>the</strong> most important part <strong>of</strong> <strong>the</strong> Agreement, <strong>the</strong>re are many<br />
o<strong>the</strong>r negotiable terms that can be just as important as <strong>the</strong> purchase price. To make your<br />
<strong>of</strong>fer as attractive as possible <strong>to</strong> <strong>the</strong> seller, be sure <strong>to</strong> pay attention <strong>to</strong> all <strong>the</strong> terms in <strong>the</strong><br />
Agreement - don’t focus only on <strong>the</strong> purchase price.<br />
How much should a buyer <strong>of</strong>fer <strong>to</strong> pay for <strong>the</strong> property? Which <strong>of</strong>fer should sellers accept?<br />
These are decisions that depend on many different fac<strong>to</strong>rs. Buyers and sellers will need <strong>to</strong><br />
consider things such as whe<strong>the</strong>r <strong>the</strong>re are o<strong>the</strong>r <strong>of</strong>fers, <strong>the</strong> recent <strong>sale</strong> prices <strong>of</strong> similar<br />
homes, how long <strong>the</strong> property has been on <strong>the</strong> market, and <strong>the</strong> motivations <strong>of</strong> <strong>the</strong> buyer<br />
and seller. Your REALTOR ® can help you review <strong>the</strong> issues <strong>to</strong> consider, but <strong>the</strong> REALTOR ®<br />
can’t make <strong>the</strong> final decision for you.<br />
