SUBPART B<br />

TYPE CERTIFICATES<br />

Note:<br />

The "type certificate" referred in <strong>HKAR</strong>-<strong>21</strong> means the type certificate issued by the State <strong>of</strong> Design.<br />

<strong>HKAR</strong> <strong>21</strong>.11 Scope<br />

This Subpart establishes the procedure for issuing type certificates for products <strong>and</strong><br />

establishes the rights <strong>and</strong> obligations <strong>of</strong> the applicants for, <strong>and</strong> holders <strong>of</strong>, those certificates.<br />

Type certificates are however granted by accepting (validating) the certification approval<br />

granted by the Authority <strong>of</strong> the State <strong>of</strong> Design as far as possible. For those aircraft types<br />

certificated by the European Joint Aviation Authorities, European Aviation Safety Agency or<br />

USA Federal Aviation Administration, the Director-General accepts that they are in<br />

compliance with the basic requirements <strong>of</strong> the Hong Kong airworthiness st<strong>and</strong>ards. No<br />

Additional Requirements or Special Conditions will be imposed.<br />

<strong>HKAR</strong> <strong>21</strong>.13 Eligibility<br />

Any natural or legal person that has demonstrated, or is in the process <strong>of</strong> demonstrating, its<br />

capability in accordance with <strong>HKAR</strong> <strong>21</strong>.14 shall be eligible as an applicant for a type<br />

certificate under the conditions laid down in this Subpart.<br />

<strong>HKAR</strong> <strong>21</strong>.14 Demonstration <strong>of</strong> capability<br />

Any organisation applying for a type certificate shall demonstrate its capability by<br />

holding a design organisation approval, issued by the Director-General in accordance<br />

with Subpart J.<br />

By way <strong>of</strong> derogation from paragraph (a), as an alternative procedure to demonstrate<br />

its capability, an applicant may seek the agreement <strong>of</strong> Director-General for the use <strong>of</strong><br />

procedures setting out the specific design practices, resources <strong>and</strong> sequence <strong>of</strong><br />

activities necessary to comply with <strong>HKAR</strong>-<strong>21</strong>, when the product is one <strong>of</strong> the<br />

following:<br />

1 a very light aeroplane or rotorcraft, a sailplane or a powered sailplane, a balloon, a<br />

hot air airship; or<br />

2 a small aeroplane meeting all <strong>of</strong> the following elements:<br />

(i)<br />

single piston engine, naturally aspirated, <strong>of</strong> not more than 250 hp maximum<br />

take-<strong>of</strong>f power (MTOP);<br />

(ii) conventional configuration;<br />
