The number of political pris<strong>on</strong>ers in <strong>Azerbaijan</strong> has fluctuated over the last few years with crackdowns<br />

followed by periodic pard<strong>on</strong>s after internati<strong>on</strong>al pressure, albeit often with strings attached that can be<br />

used to limit the freedom of acti<strong>on</strong>. High profile cases such as the release of Eynulla Fatulayev 51 took 13<br />

m<strong>on</strong>ths after a European Court of Human Rights ruling ordered his release. As of April 2012, Amnesty<br />

counted 14 detainees as ‘pris<strong>on</strong>ers of c<strong>on</strong>science’ who met their exacting standards of proof, while<br />

c<strong>on</strong>curring that a c<strong>on</strong>siderable number more would be likely to fit a broader definiti<strong>on</strong> of political<br />

pris<strong>on</strong>er with Vugar Gojayev in this publicati<strong>on</strong> suggesting a figure of around 70. Christopher Strässer, the<br />

German MP designated by the Council of Europe as the Special Rapporteur for Political Pris<strong>on</strong>ers in<br />

<strong>Azerbaijan</strong>, has been c<strong>on</strong>sistently denied entry to <strong>Azerbaijan</strong> with the authorities rejecting the principle<br />

behind his mandate. Pressure is increasingly being applied to human rights defenders, with lawyers<br />

defending protesters being disbarred 52 .<br />

Structurally, the judiciary does not have much aut<strong>on</strong>omy from the executive, or indeed from the<br />

undercurrents of patr<strong>on</strong>age that run throughout <strong>Azerbaijan</strong>i society and as such is open to political<br />

influence in sensitive cases. The Judicial Legal Council 53 is comprised of ‘15 members, 9 of whom are<br />

senior judges and the rest are representatives of the President, Parliament, General Prosecutor’s Office<br />

and the Bar Associati<strong>on</strong>’ 54 , with the Minster of Justice as the JLC’s President. Although noti<strong>on</strong>ally<br />

independent, the majority of the Committee’s members are appointed by the executive, the others by<br />

the legislature and in <strong>on</strong>e case the Bar Council. Its functi<strong>on</strong>s include the selecti<strong>on</strong> of the pool of approved<br />

judicial candidates and the disseminati<strong>on</strong> of ethics. Judges are then appointed from the pool of approved<br />

candidates to specific candidates by the President, with the excepti<strong>on</strong> of the Supreme Court, the judges<br />

for which are c<strong>on</strong>firmed by the Majlis after Presidential recommendati<strong>on</strong> 55 . The Judicial Legal Council<br />

could benefit from the presence of independent-minded lay members, at least in the area of judicial<br />

selecti<strong>on</strong>. This could include a senior representative of the Office of the Ombudsman or a representative<br />

of oppositi<strong>on</strong> parties in Majlis in the event of a more plural chamber following the 2015 Parliamentary<br />

electi<strong>on</strong>s. Similarly, removing presidential appointment of judges 56 might eventually prove beneficial if<br />

the pool of approved candidates was diversified by the JLC and greater transparency in disciplinary<br />

measures could encourage judges to make fairer judgements.<br />

One area of legislati<strong>on</strong> and practice that is in urgent need of reform is the use of the vaguely worded but<br />

liberally applied charge of hooliganism 57 . It has been applied by judges in a range of cases from a band<br />

insulting President Aliyev’s mother, political activists advertising a rally, <strong>on</strong> numerous political protestors<br />

and journalists and perhaps most famously bloggers Emin Milli and Adnan Hajizade, who themselves<br />

were victims of an attack.<br />

Policing<br />

Policing in <strong>Azerbaijan</strong> remains a work in very gradual progress. L<strong>on</strong>gstanding complaints include petty<br />

bribe taking, especially by the traffic police, aggressive c<strong>on</strong>duct and the mistreatment of suspects held in<br />

custody. Cracking down <strong>on</strong> petty, persistent police corrupti<strong>on</strong> was <strong>on</strong>e of the primary targets of the<br />

February 2011 anti-corrupti<strong>on</strong> drive, fortuitously announced just after the outbreak of the Arab Spring.<br />

This initiative did initially have some impact in changing police behaviour, bringing a pause to overt<br />
