(a) the expression “legally qualified medical practitioner”<br />

or “duly qualified medical practitioner”<br />

or “registered medical practitioner” or any<br />

expression importing a person recognised by law<br />

as a medical practitioner or a member of the<br />

medical profession shall be construed to mean a<br />

fully licensed medical practitioner or a medical<br />

practitioner registered under section 13, as the<br />

case may be; and<br />

(b) every such expression, and the expression “fully<br />

licensed medical practitioner”, shall, unless a<br />

contrary intention appears, include a person<br />

holding a licence under paragraph (b) of subsection<br />

(1) of section 11, where the only restriction<br />

or condition in his licence is a restriction or<br />

condition restricting him in the practice of<br />

medicine or surgery:<br />

Provided that nothing in this paragraph shall<br />

authorise any person to do any act or thing in contravention<br />

of any such restriction or condition.<br />

SCHEDULE (Section 3)<br />

1. (1) <strong>The</strong> Council shall consist of seven members, of whom —<br />

(a) one shall be the Chief <strong>Medical</strong> Officer ex officio;<br />

(b) two (of whom at least one shall be a fully licensed medical<br />

practitioner) shall be appointed by the Minister acting in his<br />

discretion;<br />

(c) two shall be appointed by the Minister acting in accordance<br />

with the advice of the Association; and<br />

(d) two shall be appointed by the Minister acting with the<br />

concurrence of the Association.<br />

(2) A medical practitioner shall not be appointed under head<br />

(b) or (c) or (d) of subparagraph (1) of this paragraph unless he has<br />

had at least three years actual, continuous experience of the practice<br />

of medicine within <strong>The</strong> <strong>Bahamas</strong>.<br />

(3) In the exercise of his powers of appointment under this<br />

paragraph the Minister shall ensure that, after the initial constitution<br />

of the Council, the members of the Council shall not consist<br />

entirely of persons appointed to membership of the Council at the<br />

same time.<br />

(4) In this paragraph and in paragraph 5 of this Schedule the<br />

expression “Association” means <strong>Medical</strong> Association designated in<br />

writing by the Minister for the purposes of those paragraphs.<br />
