1432, Aug. 14: [No.19] "Instrument narrating a protest made by (j) Nisbet, Alexander:<br />
William de Wedderburn, tutor to the son and heir of umquhile Heraldic Plates, p.xii.<br />
Sir <strong>John</strong> de Swynton of that Ilk, against any right pertaining<br />
to said heir being submitted to the determination of the<br />
arbiters chosen to decide certain questions between the Earls<br />
of Angus and March" [<strong>Swinton</strong> Charters No. 28]. The notary<br />
was James de Parklee, clerk of the diocese of St Andrews (g).<br />
1442: Sir <strong>John</strong> Oliphant was retoured heir to his grandfather in the lands of Cranshaws,<br />
his sasine thereon was taked Feb. 28, 1442/3 and was formally broken the next day by<br />
by Sir <strong>John</strong> <strong>Swinton</strong> of that Ilk who also claimed these lands (i).<br />
1455, June 16: Adam Nisbet was witn to an acknowledgement by William Bartrem, vicar of<br />
<strong>Swinton</strong>, of a gift of meadow land by Jon of Swyntoun (j).<br />
1458, July 26: Was named as an arbitrator in an "Instrument of Submission" by Dame Marion<br />
Douglas over a land dispute [Writ No. 122 preserved at Yester House] (h).<br />
c1460: there was a protracted battle for the ownership of Cranshaws which was being<br />
claimed for the Earldom of March. In a petition to the king, Sir <strong>John</strong> states that<br />
his grandfather, Sir <strong>John</strong> of <strong>Swinton</strong>, gave to Archibald of Douglas, for these lands, his<br />
service, and as many silver vessels as was worth 500 marks if Scottish money …… for<br />
my grandfather bought the lands [outright] considering what he paid for them; and contrary<br />
to the Earl of March, in defence of the Realm, was slain at (the Battle of) Homilidon. (f)<br />
1462, Oct 31: [No. 22] "Instrument taken at the instance of <strong>John</strong> <strong>Swinton</strong> of that Ilk on an<br />
Act of the Lords of Parliament & Council (dated 19 Oct. 1462) regarding an inquest to enquire<br />
whether the lands of Crenschawis were held in tenendry or property of the earldom of March"(g).<br />
1466/7, Jan. 26: Was a witness to a "Notarial Transumpt of No. 58 bt Pat. de Cokburn<br />
of Newbigging ……" [Writ No 132] (h).<br />
1467, Apr. 2: Was witness to an "Instrument of Assedation by Dame Annabella Boyd, relict of<br />
Edmund Hay" [No. 134] (h).<br />
1476: Lord Oliphant claiming rights raided it stealing oxen & horses of <strong>John</strong>'s (a);<br />
1481, Oct. 20: [Charter 16] Charter by Archibald, Earl of Douglas and the Lord of Galloway grants<br />
to Sir <strong>John</strong> S. Knight, for homage done and to be done the land of Cranshaws in Berwickshire.<br />
1482: Dukes of Gloucester & Albany burnt many towns in Berwickshire, including<br />
Kimmerghame, the 2 <strong>Swinton</strong>s, Bastel, etc.: Gloucester was afterwards Richard III;<br />
1483, Oct. 10: Was a Juror on an inquest in the Tolbooth of Edinburgh in which Elizabeth<br />
Cunningham was found to be heir to her father in the lands of Beltoun & Kilpallet [No.212] (h).<br />
1484: Sir <strong>John</strong> took part in insurrectionary movements<br />
with the Duke of Albany (bro. of Richard III)<br />
