C. A licensee has obtained a license through a fraud,<br />
misrepresentation, a false or misleading statement, evasion or<br />
suppression of a material fact in the license application; or<br />
D. A licensee has been convicted of an offense under a law<br />
or ordinance regulating business, a crime involving moral turpitude, or an<br />
unlawful sale of merchandise or prohibited goods; or<br />
E. A licensee engaged in an unlawful activity or common or<br />
public nuisance related to the business, which unlawful activity, or<br />
common or public nuisance shall remain unabated after notice and an<br />
opportunity for a hearing to be heard before an appropriate judicial<br />
officer or Board of Appeals. For the purpose of this Ordinance, a<br />
violation of the terms of a Building Permit, Conditional Use Permit, or<br />
Zoning Classification shall be deemed to be a common or public<br />
nuisance.<br />
The license inspector shall mail or hand-deliver written notice of<br />
revocation to the licensee or the person in control of the business at the<br />
last known address of the business. If the notice is returned as<br />
undeliverable, the license inspector shall post the notice on the front<br />
door of the business establishment. Such notification shall contain the<br />
date the revocation shall become effective, the suspension of the<br />
business license while an appeal is taken, a brief summary of the reason<br />
for the revocation, and the procedures for an appeal to the board of fee<br />
appeals.<br />
All decisions by the license inspector revoking business licenses shall be<br />
stayed until thirty (30) days after the decision of the license inspector.<br />
During the thirty-day stay of the decision, the business license of the<br />
licensee shall be suspended pending appeals. The licensee shall, if<br />
aggrieved by the decision of the license inspector, within those thirty (30)<br />
days, have the right to appeal to the board of fee appeals as provided<br />
herein. If the licensee shall timely file an appeal to the board of fee<br />
appeals, the revocation of the licensee’s business license shall be<br />
stayed until such time as the licensee shall remain suspended while the<br />
appeal of revocation is pending. The board of fee appeals or a<br />
designated representative of the board shall notify the licensee of the<br />
time, date and place for the hearing of the appeal.<br />
If the licensee shall feel aggrieved after issuance of the decision of the<br />
board of fee appeals, the licensee shall have the (10) days after receipt<br />
of the decision of the board to appeal that decision to the circuit court.<br />
The revocation shall be stayed until the expiration of the ten-day time<br />
