Both GC and her mother were uncomfortable with Dr. <strong>Duvall</strong>'s suggestion to sit on his lap. It<br />
was an unwelcome suggestion. The <strong>Panel</strong> notes that there was a power imbalance between Dr.<br />
<strong>Duvall</strong> and GC, which is why she felt she had to humor him.<br />
The <strong>Panel</strong> finds that Dr. <strong>Duvall</strong>'s conduct was inappropriate and is a serious breach <strong>of</strong> the<br />
pr<strong>of</strong>essional relationship between a dentist and his or her patient. It shows a lack <strong>of</strong> respect for<br />
the patient and demonstrates serious error in judgment. There was no possible rationale for the<br />
requests in respect <strong>of</strong> any <strong>of</strong> the women. This conduct is pr<strong>of</strong>essional misconduct within the<br />
meaning <strong>of</strong> Section 39(l)(c) <strong>of</strong> the HPA.<br />

12. In or about 2009, you failed to provide Dr. D with a copy <strong>of</strong> a Revised Agreement<br />
and Undertaking made between you and the <strong>College</strong> dated November 5, 2003<br />
("AUSPA"), contrary to the terms <strong>of</strong> the AUSPA.<br />
27. You breached your undertakings to the <strong>College</strong> as set out in the AUSPA...<br />

Dr. <strong>Duvall</strong> entered into an agreement with the CDSBC called an Acknowledgement and<br />
Undertaking <strong>of</strong> Dr. Derek <strong>Duvall</strong> with Supporting Physicians Agreements ("AUSPA) on<br />
November 5, 2003. (The AUSPA was amended in February 2005, but the amendment was<br />
minor and is not relevant to these allegations.) .. The Citation . alleges that Dr. <strong>Duvall</strong> . breached<br />
numerous provisions <strong>of</strong> the AUSPA, but the CDSBC proceeded only in respect <strong>of</strong> Sections 8 (j),<br />
(k) and (n) and Section 9.<br />
