Both GC and her mother were uncomfortable with Dr. Duvall's suggestion to sit on his lap. It
was an unwelcome suggestion. The Panel notes that there was a power imbalance between Dr.
Duvall and GC, which is why she felt she had to humor him.
The Panel finds that Dr. Duvall's conduct was inappropriate and is a serious breach of the
professional relationship between a dentist and his or her patient. It shows a lack of respect for
the patient and demonstrates serious error in judgment. There was no possible rationale for the
requests in respect of any of the women. This conduct is professional misconduct within the
meaning of Section 39(l)(c) of the HPA.
