NOW, THEREFORE, BE IT RESOLVED, that the <strong>Borough</strong> Council of the <strong>Borough</strong> of<br />
<strong>Rumson</strong> hereby supports the preliminary preferred alternative, Concept 3F, complete bridge<br />
replacement to the south of the existing bridge; and<br />
BE IT FURTHER RESOLVED, that a certified copy of this resolution shall be forwarded to<br />
the Monmouth County Engineer.<br />
The above Resolution was moved for adoption by Councilwoman DeVoe. Motion seconded<br />
by Councilman Day and carried on the following roll call vote:<br />
In the affirmative: Broderick, Day, DeVoe, Hemphill and Rubin.<br />
In the negative: None.<br />
Absent: Shanley.<br />
RESOLUTION 2013-0226-49 AUTHORIZING THE RELEASE OF THE CASH<br />
PERFORMANCE BOND FOR IMPROVEMENTS TO HOLY CROSS CHURCH:<br />
The Municipal Clerk/Administrator advised that Resolution 2013-0226-49 was releasing the<br />
prior cash performance bond from the original project for improvements to Holy Cross Church and<br />
that Holy Cross had posted the new cash performance bonds for both the parking lot and building<br />
improvements.<br />

Councilman Broderick offered the following resolution and moved its adoption:<br />
RESOLUTION<br />
WHEREAS, Holy Cross Church has posted a performance cash bond in the amount of<br />
$48,964.20 and Performance Irrevocable Standby Letter of Credit No. 0280003070, issued by<br />
<strong>Rumson</strong>-Fair Haven Bank and Trust in the amount of $440,677.80 to guarantee the completion of<br />
the bonded improvements in accordance with the Performance Guarantee Estimate dated October<br />
12, 2004; and<br />
WHEREAS, in May 2008, the <strong>Borough</strong> Council adopted a resolution reducing the amount of<br />
the Performance Irrevocable Standby Letter of Credit No. 0280003070, issued by <strong>Rumson</strong>-Fair<br />
Haven Bank and Trust to $199,349.75 and reducing the amount of the performance cash bond to<br />
$22,149.97, to reflect the work completed as of May 6, 2008; and<br />
WHEREAS, in November 2009, the <strong>Borough</strong> Council adopted a resolution reducing the amount<br />
of the Performance Irrevocable Standby Letter of Credit No. 0280003070, issued by <strong>Rumson</strong>-Fair<br />
Haven Bank and Trust to $153,439.25 and reducing the amount of the performance cash bond to<br />
$17,049.92, to reflect the work completed as of November 5, 2009; and<br />
WHEREAS, on March 5, 2012, the <strong>Borough</strong> of <strong>Rumson</strong> Zoning Board of Adjustment adopted a<br />
resolution granting Holy Cross Church Amended Preliminary and Final Major Site Plan Approval<br />
and the various conditional use variances and waivers for the renovation and expansion of the<br />
Church on Block 104, Lot 1.01, as finally revised presented to the Board of Adjustment at the<br />
meeting of January 30, 2012, subject to several conditions; and<br />
WHEREAS, the <strong>Borough</strong> Engineer in a letter dated April 16, 2012, provided a revised<br />
performance guarantee estimate that reflected the work associated with the amended approval, as<br />
well as the work from the original approval that has not been completed to date; and<br />
WHEREAS, Holy Cross Church has posted a performance cash bond in the amount of<br />
$70,807.00 and Performance Bond No. S276593, issued by NGM Insurance Company, in the<br />
amount of $637,263.00 and dated February 7, 2013 to guarantee the completion of the bonded<br />
improvements in accordance with the Performance Guarantee Estimate dated April 16, 2012; and<br />
WHEREAS, Holy Cross Church has posted a performance cash bond in the amount of<br />
$1,735.00 and Performance Bond No. S7276594, issued by NGM Insurance Company in the amount<br />
of $15,615.00 and dated February 7, 2013 to guarantee the completion of the land banked parking<br />
