DISPUTE RESOLUTION IN THE RAIL INDUSTRY<br />
New procedures are to be introduced for dealing with disputes arising in connection with regulated contracts<br />
relating to access to the railway network in England, Wales and Scotland and <strong>as</strong>sociated facilities such <strong>as</strong><br />
stations, freight terminals and maintenance depots.<br />
The new arrangements will be overseen by the Access Disputes Committee, which wishes to make the<br />
following appointments:-<br />
ALLOCATION CHAIR<br />
l Legally qualified, who will<br />
facilitate agreement between<br />
dispute parties regarding the<br />
procedures to be adopted for<br />
their particular c<strong>as</strong>e<br />
l Prepared to act <strong>as</strong> Hearing<br />
Chair<br />
l Expected commitment 12<br />
days per year unless acting <strong>as</strong><br />
Hearing Chair<br />
HEARING CHAIRS<br />
l A pool of legally<br />
qualified individuals who will<br />
chair hearings and produce<br />
written determinations of<br />
disputes<br />
l Expected commitment<br />
5 days per c<strong>as</strong>e<br />
INDUSTRY ADVISORS<br />
l A pool of rail experts who<br />
will support Hearing Chairs<br />
l Specialist railway knowledge<br />
and experience of working<br />
within the regulated access<br />
regime essential<br />
l Expected commitment 3<br />
days per c<strong>as</strong>e<br />
