<strong>Unauthorized</strong> <strong>Aliens</strong> <strong>in</strong> <strong>the</strong> <strong>United</strong> <strong>States</strong><br />
Labor Force Participation<br />
Given <strong>the</strong> age distribution <strong>of</strong> unauthorized aliens (discussed above), among o<strong>the</strong>r factors, it is not<br />
surpris<strong>in</strong>g that <strong>the</strong> labor force participation rate <strong>of</strong> unauthorized aliens is high. The Pew Hispanic<br />
Center estimates that <strong>the</strong>re were 8.3 million unauthorized aliens <strong>in</strong> <strong>the</strong> labor force <strong>in</strong> 2008,<br />
represent<strong>in</strong>g four <strong>of</strong> every five unauthorized adults <strong>in</strong> <strong>the</strong> <strong>United</strong> <strong>States</strong> that year. These<br />
unauthorized workers accounted for 5% <strong>of</strong> <strong>the</strong> civilian labor force. The labor force participation<br />
rate was considerably higher for unauthorized men than for unauthorized women. Accord<strong>in</strong>g to<br />
<strong>the</strong> Pew Hispanic Center, 94% <strong>of</strong> unauthorized men between <strong>the</strong> ages <strong>of</strong> 18 and 64 were <strong>in</strong> <strong>the</strong><br />
labor force <strong>in</strong> 2008, compared to 58% <strong>of</strong> unauthorized women <strong>in</strong> <strong>the</strong> same age group.<br />
The Pew Hispanic Center fur<strong>the</strong>r analyzed <strong>the</strong> type <strong>of</strong> work performed by unauthorized aliens and<br />
found that unauthorized workers were concentrated <strong>in</strong> low-skilled jobs. Accord<strong>in</strong>g to <strong>the</strong> Center,<br />
two-thirds <strong>of</strong> unauthorized alien laborers <strong>in</strong> 2008 were service workers (30%); construction and<br />
extraction workers (21%); or production, <strong>in</strong>stallation, and repair workers (15%). The Pew<br />
Hispanic Center analysis also considered <strong>the</strong> representation <strong>of</strong> unauthorized aliens <strong>in</strong> occupations<br />
and <strong>in</strong>dustries among all workers <strong>in</strong> civilian labor force. It found that unauthorized aliens<br />
represented well over <strong>the</strong>ir 5% share <strong>of</strong> <strong>the</strong> civilian workforce <strong>in</strong> certa<strong>in</strong> occupations. For<br />
example, unauthorized workers accounted for 25% <strong>of</strong> farm workers; 19% <strong>of</strong> build<strong>in</strong>g,<br />
groundskeep<strong>in</strong>g, and ma<strong>in</strong>tenance workers; and 17% <strong>of</strong> construction workers. 14<br />
The high levels <strong>of</strong> labor force participation by unauthorized aliens have historically been taken<br />
<strong>in</strong>to account <strong>in</strong> devis<strong>in</strong>g ways to address <strong>the</strong> issue <strong>of</strong> unauthorized immigration. For example, as<br />
discussed below, some strategies have focused on prevent<strong>in</strong>g unauthorized aliens from obta<strong>in</strong><strong>in</strong>g<br />
employment through <strong>the</strong> use <strong>of</strong> electronic employment eligibility verification systems. Some<br />
strategies to legalize <strong>the</strong> status <strong>of</strong> unauthorized aliens have similarly looked to <strong>the</strong> role <strong>of</strong> <strong>the</strong>se<br />
aliens as workers. For example, proposals have been <strong>of</strong>fered <strong>in</strong> <strong>the</strong> past to enable unauthorized<br />
aliens to obta<strong>in</strong> temporary legal status through guest worker programs. O<strong>the</strong>r proposals would<br />
make a work history <strong>in</strong> <strong>the</strong> <strong>United</strong> <strong>States</strong> a prerequisite for obta<strong>in</strong><strong>in</strong>g legal permanent resident<br />
(LPR) status.<br />
Current Law<br />
The Immigration and Nationality Act and o<strong>the</strong>r federal laws place various restrictions on<br />
unauthorized aliens. Selected provisions related to unauthorized aliens are described below. These<br />
provisions sometimes dist<strong>in</strong>guish between those unauthorized aliens who entered <strong>the</strong> country<br />
illegally, and those who entered legally but stayed beyond <strong>the</strong>ir authorized period <strong>of</strong> admission or<br />
o<strong>the</strong>rwise violated <strong>the</strong> terms <strong>of</strong> <strong>the</strong>ir admission.<br />
