SECTION 5-2-2 POWERS AND DUTIES OF TOWN MAGISTRATE (2001-A183) (2008-A355)<br />
The powers and duties of the Magistrate shall include:<br />
A. The powers and duties set forth and conferred upon him under the provisions of the state constitution and<br />
statutes, this code, and the ordinances and resolutions of the <strong>Town</strong>.<br />
B. The keeping of a docket in which shall be entered each action and the proceedings of the court therein.<br />
C. The responsibility for fixing and receiving all bonds and bails and for fixing and receiving all fines, penalties, fees<br />
and other monies as provided by law.<br />
D. Payment of all fees, fines, penalties, and other monies collected by the court at least once each month to the<br />
treasurer or other officer as designated by the Council.<br />
E. Submitting a monthly report to the Council summarizing court activities for that month.<br />
F. Preparation of a schedule of traffic violations not involving the death of a person, listing specific bail for each<br />
violation.<br />
G. Designation of a deputy other than a law enforcement officer and a specific location, at which the deputy shall,<br />
during hours when court is not open, set the amount of bail in accordance with the foregoing schedule and<br />
collect such bail, or accept proper bail bonds in lieu thereof, for and on behalf of the court.<br />
H. Preparation of a schedule of civil traffic violations listing a specific deposit for each violation. The Magistrate shall<br />
designate a person, a specific location and the hours during which such person will be at the location to accept<br />
proper deposits for civil traffic violations for and on behalf of the court.<br />
I. Prepare an annual departmental budget as required by the <strong>Town</strong> manager.<br />
J. Supervise and administer, including hiring, promotion, and termination of court employees consistent with the<br />
requirements of the <strong>Town</strong> <strong>Code</strong>, Personnel Rules, and adopted budget.<br />
K. Purchase, acquire, or retain goods and services consistent with the requirements of the <strong>Town</strong> <strong>Code</strong> and adopted<br />
budget.<br />
L. Provide coordination, input, and advice on court administrative matters to the <strong>Town</strong> Council and staff.<br />
SECTION 5-2-3 HEARING OFFICERS<br />
The Council may appoint one or more hearing officers to preside over civil traffic violation cases when, in their<br />
opinion, the appointment of such hearing officers is necessary to assure prompt disposition of civil traffic violation<br />
cases. Hearing officers may hear and dispose of civil traffic violation cases under supervision of the presiding officer<br />
of the magistrate court that are appealable to the superior court pursuant to Title 22, Chapter 2, Article 4, Arizona<br />
Revised Statutes.<br />
SECTION 5-2-4 ASSISTANT MAGISTRATE (2008-A355)<br />
The <strong>Town</strong> Magistrate may recommend to the Council the names of individuals qualified to serve as assistant<br />
magistrate, subject to the assignment and direction of the <strong>Town</strong> Magistrate, once appointed. All assistant magistrates<br />
shall serve for a specified term, subject to removal by the Council. All duly appointed assistant magistrate shall be<br />
compensated per a fee established by the Council, and subject to the reimbursement of those travel expenses and<br />
other out-of-pocket allowances permitted for <strong>Town</strong> employees. All assistant magistrates are deemed to be part-time<br />
<strong>Town</strong> employees subject to contributing to the Arizona State Retirement under certain conditions and paying payroll<br />
taxes, but are not eligible for benefits such as health insurance and paid time off.<br />
