When it comes to IP, India is in the midst of an important paradigm shift. Since the recognition of the vital role played by IP to India’s developing industries, an increasing amount of attention is being paid to the nuances of IP law and its development in the region. The need for a stronger domestic IP system remains a pressing one. In the last decade, India’s IP system has undergone thorough reform to bring it in line with international standards, unique issues remain and new complexities are rising up. THE EVENT Last year we covered issues ranging from how to get the strongest patent and trade mark registrations from India’s Patent and Trade Mark Offices, to the best means for enhancing the scope of software patent protection. This year’s forum will bring an updated and fresh programme of discussions and practical advice pertaining to the evolving issues encountered by India’s many businesses striving to protect their intellectual property and to monetise their intellectual assets. Given the series of important pharmaceutical patent decisions in the last 12 months, including the compulsory licence over Nexavar, Cipla’s victory in the Delhi High Court and the hearings in the long-running Glivec patent case in the Supreme Court, discussions over pharmaceutical patents are bound to feature. Furthermore, topics such as parallel importation, trade mark infringement and how the smartphone patent wars could affect India will be addressed by leading experts in the field. Attention will also be paid to the issue of the necessary filing of paperwork which corporations in India must achieve in order to establish the extent to which each of their patents has been worked; accurately documenting information regarding revenue generation and sales of each patented product. This is a complex issue and good guidance will be considered of great value by the in-house lawyers that form the backbone of the attendance. The forum will bring together leading counsel with domestic and international advisers to impart their expertise through a series of high-level panel discussions.
