Mandandanji People #2 - National Native Title Tribunal

Brief history of the application
This application was the second lodged on behalf of the Mandandanji People, on 28
October 1997. The first application of the Mandandanji People (QC97/30) was
lodged on 12 September 1997 and withdrawn on 7 July 1998. The notification of
interested persons and organisations has not yet commenced. An amended
application was lodged in the Federal Court on 30 September 1999 and leave to
amend was granted by the Court on 13 October 1999.
In making this decision I have considered material provided directly to the Tribunal
for my consideration in the application of the registration test and in some instances
relied on this material in making this decision. This material included: the affidavits
of (name deleted) dated 8 November 1999, (name deleted) dated 25 June 1999 and
(name deleted) dated 9 September 1999; a letter from (name deleted) dated 11
November 1999 and a letter from the applicants legal representatives dated 30
November 1999 in relation to this letter.
After agreement was reached with the State of Queensland (‘State’) about the
conditions of release of this material, copies of the documents were provided to the
State. By letter of 10 February the State indicated to the Tribunal that it did not wish
to respond to the material. (See State of Western Australia v Native Title Registrar &
Ors [1999] FCA 1591 – 1594 regarding the Tribunals responsibility to afford the State
an opportunity to comment on material it considers).
