Can<strong>to</strong>n man facing<br />

jail in assault case<br />

A Can<strong>to</strong>n man is facing a<br />

preliminary hearing Friday<br />

on charges of felonious assault<br />

involving a police officer and<br />

operating a vehicle while<br />

impaired, third offense.<br />

Edward Walsh, 55, could<br />

face penalties ranging up <strong>to</strong><br />

five years in prison if he is convicted<br />

as charged.<br />

Walsh was arrested Oct. 28<br />

after police say he made a 9-<br />

1-1 call from an area hospital<br />

parking lot, where he had gotten<br />

in<strong>to</strong> an unrelated dispute.<br />

After police arrived, Walsh<br />

is accused of driving his vehicle<br />

<strong>to</strong>ward an officer who had<br />

gotten out of his patrol car,<br />

Detective Sgt. Dave Schreiner<br />

said.<br />

Walsh was charged and<br />

initially jailed with a $50,000<br />

cash bond set in 35th District<br />

Court, but he has since been<br />

released after his family posted<br />

the bond, Schreiner said.<br />

Can<strong>to</strong>n police have had<br />

several previous contacts with<br />

Walsh.<br />

Hearing wraps on Orlewicz new<br />

Elizabeth Jacobs believes Wayne<br />

County Circuit Court Judge Annette<br />

Berry abused her discretion and denied<br />

Jean Pierre Orlewicz an adequate<br />

defense when she refused <strong>to</strong> allow testimony<br />

in Orlewicz's trial for murder in<br />

the death of Daniel Sorensen.<br />

Jeffrey Caminsky disagrees and<br />

says that, while such testimony may<br />

have made for interesting listening, it<br />

wouldn't have made a difference in the<br />

outcome of Orlewicz's 2008 trial.<br />

Jacobs, Orlewicz's appellate at<strong>to</strong>rney,<br />

wants Wayne County Circuit Court<br />

Judge Bruce Morrow <strong>to</strong> order a new trial<br />

for Orlewicz, the Plymouth Township<br />

teen who stabbed, beheaded and burned<br />

Sorensen in November 2OO7- Caminsky,<br />

a Wayne County assistant prosecu<strong>to</strong>r,<br />

obviously opposes such a motion.<br />

of SEMCOG and John Swa<strong>to</strong>sh,<br />

representing the Regional<br />

Transit Coordinating Council •<br />

— brought their rapid-transit<br />

plan <strong>to</strong> Can<strong>to</strong>n.<br />

"A lot of people are asking<br />

about (regional transportation),"<br />

said Slavens. "Many people<br />

would prefer instead of getting<br />

in<strong>to</strong> their cars <strong>to</strong> get on a bus or a<br />

rail system."<br />

The Detroit Regional Mass<br />

Transit Initiative would give<br />

them that opportunity. The plan<br />

would add various layers of public<br />

transportation, ranging from<br />

enhancement of Detroit DOT<br />

and MDOT services <strong>to</strong> a commuter<br />

rail service throughout<br />

southeastern <strong>Michi</strong>gan.<br />

examination<br />

of Orlewicz by Dr.<br />

Gerald Shiener and Orlewicz<br />

her contention Shiener's<br />

testimony would have been irrelevant.<br />

Jacobs said the decision was an abuse<br />

of Berry's judicial discretion and was<br />

tantamount <strong>to</strong> denying Orlewicz a right<br />

<strong>to</strong> counsel.<br />

During the hearing before Morrow,<br />

Shiener and two psychiatrists called<br />

by Caminsky testified about Orlewicz's<br />

upbringing, his being diagnoses<br />

with Attention Deficit Hyperactivity<br />

Disorder and whether he feared for his<br />

life when he entered the Can<strong>to</strong>n garage<br />

of his grandfather and killed Sorensen.<br />

The plan would cost some $6.5<br />

<strong>to</strong> $10.4 billion over the next 26<br />

years, depending on how much<br />

of it is implemented. Those costs<br />

would include capital expenditures<br />

as well as operating costs.<br />

But Donigan, who is pushing<br />

the issue in the state House, said<br />

<strong>Michi</strong>gan needs the system <strong>to</strong><br />

keep pace with other cities — she<br />

cited Phoenix and Dallas, among<br />

others — around the country.<br />

"We need <strong>to</strong> move better,<br />

faster and smarter if we want<br />

<strong>to</strong> catch up with the rest of the<br />

country," said Donigan, who said<br />

the 2000 Census said 10 percent<br />

of <strong>Michi</strong>gan residents don't have<br />

cars. "All those cities that were<br />

based on cars know their residents<br />

need an alternate means of<br />

transportation."<br />

The Detroit Regional Mass<br />

Transit Initiative would:<br />

•Expand service time and<br />

increase frequency of existing<br />

bus routes and make bus s<strong>to</strong>p<br />

enhancements;<br />

• Likely include Plymouth and<br />

Can<strong>to</strong>n as a hub, if those communities<br />

opt in<strong>to</strong> the plan.<br />

• By 2012 add light-rail along<br />

Woodward, commuter rail from<br />

Jacobs said that, while it may not have<br />

resulted in an acquittal, she believes<br />

Orlewicz's mental state may have been a<br />

fac<strong>to</strong>r in the jury's decision whether <strong>to</strong><br />

convict Orlewicz of first-degree murder<br />

or a lesser charge.<br />

"If it's a battle of the experts, then it's<br />

a battle of the experts," Jacobs said. "But<br />

it should have happened in front of the<br />

jury. Berry abused her discretion ... it<br />

was a miscarriage of justice."<br />

Caminsky said none of the doc<strong>to</strong>rs<br />

found any evidence Orlewicz was delusional<br />

at the time of the crime, and said<br />

there was "no evidence he would have<br />

misinterpreted what was happening."<br />

"(Shiener's) testimony, while interesting,<br />

would have had no effect on the<br />

fact-finders," Caminsky said. "Whether<br />

Berry had allowed some of this testimony,<br />

it simply would have had no bearing<br />

on the outcome."<br />

Such a system, Donigan<br />

believes, would be an economic<br />

boon <strong>to</strong> the region by allowing<br />

people not only <strong>to</strong> get <strong>to</strong> jobs, but<br />

also <strong>to</strong> get <strong>to</strong> retail outlets, shopping<br />

areas, etc.<br />

"People ride public transportation<br />

<strong>to</strong> spend money and<br />

<strong>to</strong> make money, and we need<br />

a whole lot of that," she said.<br />

"We can't afford <strong>to</strong> leave anyone<br />

behind."<br />

The plan has initial approval<br />

of what Donigan called "The<br />

Big Four" - Oakland County<br />

Executive L. Brooks Patterson,<br />

Wayne County Executive Robert<br />

Ficano, the mayor of Detroit<br />

and the Macomb County<br />

Commission.<br />

Proponents know the cost<br />

could be prohibitive, but point<br />

out other areas are paying more.<br />

According <strong>to</strong> Swa<strong>to</strong>sh, the average<br />

spending on public transportation<br />

in the <strong>to</strong>p 25 metropolitan<br />

areas in the country is $185 per<br />

capita; <strong>Michi</strong>gan's is $75.<br />

The plan would create a<br />

Regional Transit Authority that<br />

would manage the system's budget.<br />

But Swa<strong>to</strong>sh said the economic<br />

benefits could outweigh<br />

the costs. He said a rapid transit<br />

system would create immediate<br />

jobs, attract employers, help<br />

retain a workforce, particularly<br />

among young people, and<br />

improve tax revenues.<br />

"We know from extensive<br />

studies that transportation alternatives<br />

are one of the <strong>to</strong>p three<br />

things major companies look at,"<br />

Donigan said. "We also know<br />

when young people are deciding<br />

where <strong>to</strong> live, they don't want <strong>to</strong><br />

be dependent on cars.<br />

"There's no doubt it'll cost a lot<br />

of money," she added. "No one<br />

hides from that fact. But it's an<br />

investment in our future."<br />
