<strong>The</strong> <strong>Slovene</strong> <strong>Police</strong> 40<br />
Due to the nature of its work the division co-operates with professional<br />
services of the police, as well as with other State institutions and<br />
authorities, especially with the ombudsman, the Ministry of Foreign<br />
Affairs, the Office of the President of the Republic and with the Office<br />
of the President of the Government, with the Commission for petitions,<br />
applications and complaints of the National Assembly. <strong>The</strong>y submit to<br />
the police the initiatives, petitions and letters of individual citizens, who<br />
have addressed their problems connected either with the treatment of a<br />
policeman or with his conduct, to them. Every year they deal with about<br />
30 petitions, 70 initiatives submitted by the ombudsman and with about<br />
50 complaints. Replies to foreigners are submitted through the Ministry<br />
of Foreign Affairs.<br />
Complaints<br />
<strong>The</strong> initiatives, proposals and complaints of individual persons are a part of<br />
police profession. <strong>The</strong> <strong>Police</strong> accept them as a form of public control over their<br />
work and as an obligation for even greater professionalism in the performance of<br />
their duties.<br />
Article 28 of the <strong>Police</strong> Act provides: “If an individual believes that his/her rights or<br />
freedoms were breached by an activity, or by the omission of an activity by a<br />
policeman, he/she can, in addition to all<br />
other legal and other means available for the<br />
protection of his/her rights and freedoms,<br />
also enter a complaint with the police within<br />
a period of 30 days.”<br />
<strong>The</strong> complaint procedure follows precisely<br />
defined methodology and directives, which<br />
enable the transparency of the procedure,<br />
since it is possible at any time to establish,<br />
whether everything possible was done<br />
during the procedure in order to define the<br />
exact situation. However, it tries to solve all<br />
the problems, cited in the complaint, also in<br />
co-operation with the applicant.<br />
A senate composed of three members: the chairman of the senate, a<br />
representative of the public and a representative of the <strong>Police</strong> Union,<br />
thoroughly evaluate the complaint and decide on the substantiation of<br />
the complaint. <strong>The</strong> representatives of the public in the senate at the local<br />
level are the candidates of local communities. <strong>The</strong>ir number depends on<br />
the number of complaints. At the State level the public is represented by<br />
the members of professional public from legal or judicial ranks.
