g. Captions. The captions appearing in this Declaration are for convenience only, and are not a part of this Declaration and do not in any way limit or amplify the terms or conditions of this Declaration. h. Parties Bound. This Declaration sets forth the entire agreement as of the date hereof between Seller and Purchaser with respect to the subject matter set forth herein. It is binding upon and shall inure to the benefit of the parties hereto and their respective heirs, personal representatives, legatees, devisees, successors and assigns. This Declaration shall be “covenants running with the land,” running with and being binding upon all of the future owners of Property. This Declaration may be altered or amended only by written notice executed by Seller and Purchaser or their legal representatives or, in accordance with the provisions of this Declaration, their successors in interest. i. Governing Law. This Declaration shall be interpreted in accordance with and governed by the laws of Wisconsin. The language in all parts of this Declaration shall be, in all cases, construed according to its fair meaning and not strictly for or against Seller or Purchaser. j. Recording. The parties agree, as an alternative to the recordation of this Declaration, to execute a so-called Memorandum of Declaration or Short Form Declaration in form recordable and complying with applicable law and reasonably satisfactory to Seller’s attorneys. Any such document shall expressly state that it is executed pursuant to the provisions contained in this Declaration, and is not intended to vary the terms and conditions of this Declaration.
