Avoidance for non-disclosure is a drastic remedy. It<br />

enables <strong>the</strong> <strong>in</strong>surer to disclaim liability after, and not<br />

before, he has discovered that <strong>the</strong> risk turns out to be a bad<br />

one; it leaves <strong>the</strong> <strong>in</strong>sured without <strong>the</strong> protection which he<br />

thought he had contracted and paid for...I do consider <strong>the</strong>re<br />

should be some restra<strong>in</strong>t <strong>in</strong> <strong>the</strong> operation <strong>of</strong> <strong>the</strong> doctr<strong>in</strong>e.<br />

Avoidance for honest non-disclosure should be conf<strong>in</strong>ed to<br />

pla<strong>in</strong> cases. 102<br />

However, <strong>the</strong> weight <strong>of</strong> <strong>the</strong> case law and <strong>the</strong> force <strong>of</strong> <strong>the</strong> 1906 Mar<strong>in</strong>e<br />

<strong>Insurance</strong> Act <strong>in</strong>evitably present considerable hurdles to judicial<br />

<strong>in</strong>tervention. Never<strong>the</strong>less, <strong>the</strong> subject <strong>of</strong> non-disclosure and <strong>the</strong> <strong>in</strong>surers’<br />

remedy has not escaped <strong>the</strong> attention <strong>of</strong> law reform agencies.<br />

A. LEGISLATIVE REFORM: A FALSE DAWN<br />

In 1978, <strong>the</strong> Law Commission was given <strong>the</strong> opportunity to review<br />

non-disclosure. 103 This was to be carried out <strong>in</strong> <strong>the</strong> light <strong>of</strong> a proposed EEC<br />

Directive on <strong>the</strong> Co-ord<strong>in</strong>ation <strong>of</strong> Legislative, Statutory and Adm<strong>in</strong>istrative<br />

Provisions relat<strong>in</strong>g to <strong>Insurance</strong> <strong>Contracts</strong>, <strong>the</strong> object <strong>of</strong> which was to<br />

harmonise <strong>the</strong> law <strong>in</strong> <strong>the</strong> Community. 104 Of particular concern to <strong>the</strong> U.K.<br />

was <strong>the</strong> recommendation that <strong>the</strong> proportionality pr<strong>in</strong>ciple should be<br />

adopted. Under French law, for example, an <strong>in</strong>surer is obliged to pay <strong>the</strong><br />

proportion <strong>of</strong> <strong>the</strong> claim which <strong>the</strong> actual premium paid bears to <strong>the</strong><br />

premium which would have been payable if <strong>the</strong> material facts had been<br />

disclosed. 105 In this way, any additional risk and <strong>the</strong> loss attributable to that<br />

additional risk is, <strong>in</strong> effect, borne by <strong>the</strong> <strong>in</strong>sured. A more complex set <strong>of</strong><br />

provisions was adopted <strong>in</strong> <strong>the</strong> proposed EEC Directive. Article 3.3(c) <strong>of</strong><br />

<strong>the</strong> Proposed Directive dealt with <strong>the</strong> <strong>in</strong>surer's right <strong>in</strong> respect <strong>of</strong> <strong>in</strong>nocent<br />

non-disclosure. 106 It adopted <strong>the</strong> pr<strong>in</strong>ciple <strong>of</strong> proportionality only where<br />

non-disclosure is due to fault (short <strong>of</strong> fraud) on <strong>the</strong> part <strong>of</strong> <strong>the</strong> <strong>in</strong>sured. 107<br />
